Crimes targeting the socially underprivileged have significant social impact. Imposing aggravated punishment for such offenses can enhance the general preventive effect, thereby deterring similar crimes, while severe penalties may also contribute to special prevention by reducing recidivism. As Korea enters a super-aged society, the attractiveness and vulnerability of the elderly as crime targets are likely to increase. Nevertheless, when looking at the legal basis and institutional status related to support for the protection of crime victims, it is difficult to find content that considers elderly victims classified as elderly. Even under the Criminal Procedure Act, elderly defendants over 70 years of age can receive assistance from lawyers to guarantee the right to defend, whereas comparable protections for victims' rights remain insufficient. Given that elderly individuals who maintain active social lives are at heightened risk of economic and emotional abuse, sustained efforts are needed to build a social safety net that enables their safe and continued social participation.

사회적 약자를 대상으로 한 범죄는 그 자체로 사회적 파장이 크며, 이러한 범죄를 가중처벌 하면 유사범죄를 예방하는 일반예방효과가 커지고, 더불어 가해자에 대한 엄중한 처벌은 재범을 방 지하는 특별예방효과에도 기여할 수 있다. 현재 우리나라는 초고령사회에 직면함에 따라 향후 노인 이 범죄대상으로서의 매력성과 취약성은 확대될 수밖에 없는 사회구조를 맞이하였다. 그럼에도 불구 하고 범죄피해자 보호 지원에 관련된 법적 근거와 제도현황을 살펴보면, 고령자로 분류되는 노인피 해자를 배려하는 내용은 찾기 어렵다. 심지어 형사소송법에는 70세 이상인 고령의 피고인은 방어권 보장을 위해 변호사의 조력을 받을 수 있는데 비하여, 피해자의 인권보호는 다소 미비한 실정이다. 사회생활을 다양하게 하는 노인들이 경제적, 정서적 학대에 노출될 가능성이 높다는 사실에 주목하 여, 적극적인 사회생활을 영위할 수 있는 사회안전망을 확보하기 위한 노력도 지속되어야 할 것이다.
