Unlike the service performed by other government agencies, the service of firefighting organizations is unique in that it is performed in dangerous situations and extreme environments such as fire, rescue, and first aid. Considering the special nature of firefighting equipment, it needs to establish the procurement contract system that reflects the needs of each city/provincial firefighting headquarters as well as those of actual users to achieve the purpose of purchasing excellent firefighting equipment. This study aims to analyze problems of the existing procurement contract system which accounts for most of the purchase procedures of firefighting equipment conducted by fire departments, etc., and to suggest improvements and alternatives. Policy measures focusing on primary improvement measures are presented as follows: First, from an institutional perspective, control measures through new regulatory means are needed. Second, it needs a control alternative that systematically supervise the distorted discretionary behavior of the person in charge of the purchasing process of the demanding agency where actual purchasing administration takes place aiming for limited authority.

소방조직은 다른 정부기관에서 수행하는 업무와는 다르게 화재, 구조, 구급과 같은 위험상황에서 활동한다는 특별함과 극한의 환경에서 사용해야 한다. 소방장비의 특수성을 고려해 볼 때 각 시·도 소방본부가 요구하는 바와 더불어 실사용자 위주의 요구가 반영되고 우수장비 구입목적을 이룰 수 있는 소방기관 또는 소방장비만 을 대상으로 하는 자체 소방장비 조달계약 시스템의 구축이 필요하다. 본 연구의 목적은 소방본부 등이 진행하는 소방장비 구매절차 중 대부분을 차지하는 조달계약 체계에 대한 문제점과 사례를 분석하고 개선점 과 대안을 제시하는 데 있다. 주요 개선방안을 중심으로 정책적 방안을 제시하면 다음과 같다. 첫째, 제도적 측면에서 새로운 규제수단을 통한 통제적 방안이다. 둘째, 실질적 구매행정이 이루어지는 수요기관의 구매절 차에 대해 업무담당자의 굴절된 재량행위를 제도화로 단속하고 이러한 한계적 권한을 지향하는 방향의 통제적 대안이다.
