In flight, the aircraft is in an environment without any external physical assistance, and under the command and supervision of the captain, the cabin crew and Security Personnel on Board Aircraft are required to prevent various types of acts of unlawful conduct in accordance with current legislation. In order to prevent and actively respond to illegal acts on board aircraft, relevant legal provisions based on the duties and responsibilities of Security Personnel on Board Aircraft must be stipulated specifically and clearly. However, the current legal system stipulates that Security Personnel on Board Aircraft are appointed by the judicial police management and air transport operators in the Aviation Security Act, and the authority and responsibility of duties are defined as Guidelines for Operation of Security Personnel in Aircraft. The same operating guidelines are not legally enforceable as administrative regulations of the Ministry of Land, Infrastructure, There is a limit to the Security Personnel on Board Aircraft performing their duties. In order to enhance the safety of aircraft during flight, the qualification standards, authority and responsibilities, responses and procedures, etc. of Security Personnel on Board Aircraft l stipulated in administrative regulations shall be Legislation of the Aviation Security Act. Security Personnel on Board Aircraft must overcome procedural limitations in the performance of their duties and ensure the status and authority to exercise judicial power.

운항중인 항공기는 외부의 어떠한 물리적 조력을 받을 수 없는 환경에서 기장의 지휘·감독하에 객실 승무원과 항공기내보안요원이 현행 법제도에 따라 다양한 유형 과 행태의 불법행위으로부터 승객의 안전과 항공기의 보안을 확보하여야 한다. 항공 기내 불법행위를 예방하고 적극적인 대응을 하기 위해서는 항공기내보안요원의 직 무 권한에 따른 관련 법 규정이 구체적이고 명확하게 규정되어야 한다. 하지만 현행 법제도는 ｢항공보안법｣에 항공기내보안요원을 사법경찰관리와 항공운송사업자가 지명한 사람으로 규정하고, 직무의 권한과 책임은 ｢항공운송사업자의 항공기내보안 요원 등 운영지침｣에 명시하여 항공기내보안요원을 운영하고 있는 실태이다. 이 운 영지침은 국토교통부 행정규칙으로서 법적 실효성이 없어 항공기내보안요원이 직무 를 수행하는데 그 한계가 있다. 운항중인 항공기내 안전성을 강화하기 위해서는 행 정규칙에서 규정하고 있는 항공기내보안요원의 자격기준, 권한과 책임, 대응 및 절 차 등을 ｢항공보안법｣에 입법하여 항공기내보안요원이 직무수행을 함에 있어 절차 적 한계를 극복하고 사법권을 행사할 수 있는 지위와 권한을 확보하여야 한다.
