There are criminal disposition and protection disposition for improvement through education and treatment in judicial policy for criminals. These protection disposition has been practiced in schools, investigative agencies and courts through diverse systems and laws. But these protective disposition is not considered traits of developmental disability in substance because it is centered around a normal boy and non-disabled with normal cognitive ability. Therefore, there has been a basic limitation to rehabilitation through protective treatment for criminals with developmental disabilities. Therefore, it is only useful for the adequate rehabilitation for them if contextual protective disposition considering their traits which are defined in the developmental disability act and the prevention of discrimination against disabled persons act has to be done in schools, investigative agencies, courts. That is because we don’t usually approach criminals with developmental disability whose cognitive abilities and communication are weak and in a different context from those of the non-disabled by normal protection procedure. Therefore, I emphasized the importance of developmental disability friendly protective disposition after looking at the problem of existing protective disposition for them.

범죄인에 대한 사법적 제재에는 형벌 등을 통한 형사처분과 교육과 치료 등을 통해 개선을 도모하는 보호처분이 있다. 이러한 보호처분은 학교, 수사기관, 법원 에서 여러 제도와 법을 통해 행해져오고 있다. 그러나 범죄인에 대한 보호처분은 비장애인과 인지능력이 정상적인 장애소년을 중심으로 운영되고 있어 발달장애 인의 특성이 실질적으로 고려되지 않고 있다. 그 결과 발달장애범죄인에 대한 보 호를 통한 교화에는 한계가 있다. 따라서 실질적으로 장애인차별금지법과 발달장 애인법에서 규정한 발달장애인의 특성과 맥락을 고려한 보호처분이 되는 것이 발달장애범죄인에 대한 적절한 교화에 도움이 된다. 그것은 인지력과 의사소통능 력이 약하고 범죄행동에서 비장애인과 다른 맥락을 가질 수 있는 발달장애인에 대해서는 통상적인 보호절차로 접근해서는 한계가 있기 때문이다. 따라서 본 논 문에서는 발달장애범죄인에 대한 보호처분의 문제점을 살펴보고 개선방안을 제 시하여 발달장애인 친화적 보호복지의 중요성을 강조하였다.
