The purpose of this study is to present a plan to protect digital personality rights in cyberspace. The research method focuses on various materials such as papers, reports, and reports on cyber space and digital personality rights, defamation of Internet reputation, relief of cyber rights violations, and freedom of expression. Studies have shown that the number of cases of digital personality rights violations in cyberspace continues to increase, and that this violation is contrary to the constitutional freedom of expression. In order to guarantee freedom of expression and protect digital personality rights, related legislation on physical and geographical space should be reorganized, and Internet service providers, platform operators, and media companies should make self-purification efforts. This study focuses on the protection of digital personality rights and contributes to the presentation of basic directions in the revision of relevant laws, which can be used as basic data for future violations of personality rights in cyberspace.

본 논문은 사이버 공간에서의 디지털 인격권 보호 방안을 제시하는 데 목적이 있다. 연구 방법은 사이버 공간과 디지털 인격권, 인터넷 명예훼손, 인터넷에서의 인격권 침해 피해 구제, 사이버 공간에서의 표현의 자유 등 을 다룬 논문과 기사, 보고서 등 각종 자료를 중심으로 진행하였다. 연구 결과, 사이버 공간에서의 디지털 인격권 침해 사례는 지속적으로 증가하는 양상을 보이고 있으며, 이러한 침해 문제는 헌법이 보장하는 표현의 자유와 상 충하고 있음을 확인할 수 있었다. 표현의 자유를 보장하되 디지털 인격권을 보호하기 위해서는 물리적, 지리적 공 간을 대상으로 하는 관련 법제의 재정비가 요구되며, 사이버 공간에서 발생할 수 있는 디지털 인격권 침해에 대하 여 인터넷서비스제공자, 플랫폼 사업자, 언론사 등의 자정 노력이 수반되어야 할 것이다. 본 연구는 디지털 인격권 보호 방안에 중점을 두고 관련 법제를 개정하는 한편, 자율규제기구의 역할 강화를 통한 디지털 인격권 보호를 위 한 기본적인 방향의 제시에 기여할 것이며, 향후 사이버 공간의 인격권 침해 사례의 기초 자료로 활용될 수 있다.
