The Chinese government is continuing its policy to distribute digital currency for the first time in the world, while conducting experiments in pilot areas. The Chinese government is pushing to issue a digital yuan to reduce its dependence on the dollar and to identify capital flows and capital outflows. However, issuing digital yuan requires reform of the existing financial system, so policy, legal modification and supplementation are important. Under this background, the purpose of this study was to first identify the nature of digital yuan and its basic structure for issuance, and to confirm its direction through digital yuan experiments in Shenzhen. The results of the study are as follows. First, the essential issue of digital yuan is whether it is currency or digital assets, and the issue of ownership and security is becoming an issue. Second, digital yuan is regarded as a special copper coin, although it is not a type of copyright. However, in order for digital yuan to secure legal compensation in legal currency, legal supplementation to the nature of the currency is necessary. Third, unlike the existing mobile payment system, digital yuan maintains its properties as a currency and will be used extensively, although certain restrictions are given. The digital yuan experiment in Shenzhen this time was also issued by confusion in payment at the consumption site due to lack of publicity. From the perspective of consumers, it was difficult to recognize the nature of the digital yuan and its distribution structure through the difference between the legal currency properties of digital yuan and mobile payments. However, many issues have still not been resolved because the purpose of the digital yuan's release is linked to the promotion of consumption. The Chinese government announced three experiments during the Spring Festival and is expected to conduct experiments in better demonstration areas. Through this, digital yuan will secure legal currency status and prepare for nationwide distribution. According to this research rule, digital yuan needs to be distributed nationwide to solve the problem of refusal to receive it unlike cash.

중국정부는 세계 최초로 디지털화폐를 유통하기 위해 관련 정책을 계속해서 내놓고 있으며, 다른 한편으로는 시범지역을 통해 실험을 진행하고 있다. 중국정부는 달러화에 대한 의존도를 낮추고 자금흐름과 자본유출을 파악하기 위해 디지털위안화 발행을 추진하 고 있다. 그러나 디지털위안화 발행은 기존 금융체계의 개혁이 필요하기 때문에 정책적, 법적 수정, 보완이 중요하다. 이러한 배경 하에 본 연구는 먼저, 디지털위안화의 본질과 발행을 위한 기본구조를 확인하고 선전시의 디지털위안화 실험을 통해 이에 대한 방향성 을 확인하는 것이 연구목적이었다. 연구결과는 다음과 같다. 첫째, 선전시의 실험에서 보면 디지털위안화는 법정통화의 기준에는 못미치나 법정화폐의 발행을 위한 준비단계라 고 볼 수 있다. 둘째, 디지털위안화가 법정화폐로 법적 보상성을 확보하기 위해서는 화폐본질에 대한 법적 보완이 필요하다. 선전시 실험에서 디지털위안화는 소비진작을 위해 지방자치단체가 자금을 출자하고 일정지역, 일정 사용자만 참여하였기 때문에 완벽 한 법적 보상성을 확보하지 못했다. 다만 중앙은행이 발행하고 상업은행이 유통하는 구조는 법정화폐와 유사하기 때문에 디지털위안화는 물권의 객체로서 법적 구속력을 확보할 것으로 예상된다. 셋째, 선전시에 나타난 디지털위안화는 인터넷이 필요하지 않으며 디지털화폐 계좌에서 직접 정산되는 구조로 모바일결제와의 차이가 뚜렷하다. 금번 선전시 디지털위안화 실험은 홍보 부족으로 소비현장에서 결제에 혼란이 발행 하기도 하였다. 소비자 입장에서도 사용기간과 장소가 한정되어 화페로서의 속성을 인 식하기 힘들었다, 다만 본 실험에서 디지털위안화의 법정화폐 속성과 모바일결제와의 차이를 통해 디지털위안화의 본질과 유통구조를 확인할 수 있었다. 다만 디지털위안화 의 출시 목적이 소비진작과 연결되어 있어서 많은 쟁점이 여전히 해결되지 못하였다.
