In Korea, technologies that have a significant impact on national security when it releases to foreign nations are designated as national core technologies and the technologies are protected through related laws and support projects. However, it has been argued that there is a lack of awareness of the national core technology and the effectiveness of the protection system is not sufficient. In addition, existing studies related to the protection of national core technologies are insufficient and oriented to specific subject areas, indicating the improvement of the system. Therefore, this study examines the problems of the current national core technology protection system from the perspective of the mosaic theory and confirmed the paradox that “protection through excessive confidentiality” could rather weaken protection. As a fundamental solution to the problems of the national core technology protection system, “protection through the appropriate level of disclosure” is proposed. A partial disclosure plan of the state-of-the-art national core technology survey, and the national core technology master system are also suggested. This study has academic significance in that it discusses the problems of the current system of the national core technology of Korea from the perspective of the mosaic theory. It is also expected that this study may contribute to solving the problems of the national core technology protection system in practice.

우리나라는 해외유출 시 국가안보 등에 중대한 영향을 줄 수 있는 기술을 국가핵심기술로 지 정하고 관련 법제 및 지원사업 등을 통해 보호하고 있다. 그러나 여전히 국가핵심기술에 대한 인 식이 부족하고 보호제도의 실효성이 부족하다는 주장이 제기되고 있다. 뿐만 아니라 국가핵심기 술 보호 관련 연구는 매우 부족하고 특정한 주제 분야에 치우쳐져 있어 제도 개선에 한계가 있 다. 이에 본 연구에서는 모자이크 이론 관점에서 현 국가핵심기술 보호제도의 문제점을 고찰하 고 ‘과한 비공개를 통한 보호’는 오히려 보호를 취약하게 할 수 있다는 역설에 대해 논의한다. 국 가핵심기술 보호제도의 문제점에 대한 근본적인 해결방안으로 ‘적정 수준의 공개를 통한 보호’를 제안하고, 국가핵심기술 실태조사의 부분적 공개방안, 국가핵심기술 명장제도 등을 세부 방안으 로 제시하였다. 본 연구는 모자이크 이론의 관점에서 국가핵심기술 관련 현 제도의 문제점을 논 하였다는 점에서 학술적으로 의미가 있고, 실무적으로는 국가핵심기술 보호제도의 문제점 개선에 기여할 수 있을 것으로 기대한다.
