On December 22nd, 2020, the revision of Police Law was passed by Korean National Assembly. The newly revised Police Law was renamed as the Law on Organization and Operation of the National Police and Autonomous Police came into effect from January 1st, 2021. The process of the revision of Police Law which marked the implementation of the autonomous police system was widely criticized in many respects include the necessary of the autonomous police system, the problem of forming social consensus, and the lack of consultation with both sides of the national police agency and local governments. This study put forward some opinions by giving an overview of the establishment process and revised contents of the autonomous police system. For a better explanation of the crucial issue, theoretical discussion of police system primarily focused on three paradigms of police organization all over the world. The conclusion is clear that the biggest distinction between national police system and autonomous police system does not lie in the nature of specific affairs (national affairs or autonomous affairs). The essence of the police system depends on the main body and the mode of operation of police force. Through the critical discussion of the newly reformed Korean police system, this study offered a guide of more successful police system to the future.

기존의 경찰법을 대상으로 한 경찰법 전부개정안이 2020년 12월 22일 국회를 통과함에 따라 2021 년 1월 1일자로 새로운 경찰법인 “국가경찰과 자치경찰의 조직 및 운영에 관한 법률”이 시행되었다. 경찰법을 전부개정하여 새로운 경찰법을 시행하는 과정에서 치경찰제를 실시하게 된 필요성, 사 회구성원들의 공감대 형성, 경찰 또는 지방 정부 등 운영의 주체들의 의견 수렴 등이 충분이 이루어 지지 못한 상태에서 새로운 경찰제도가 도입되었다는 비판들이 있다. 따라서 본 연구에서는 우리의 자치경찰제도의 도입과정과 그 개정내용에 대한 구체적 검토와 의 견을 제시하였다. 내용의 전개를 위하여 세 가지 경찰조직의 패러다임을 중심으로 한 경찰제도에 대 한 이론적 논의를 바탕으로, 국가경찰과 자치경찰 등의 구분은 국가경찰사무, 자치경찰사무 등 업무 의 구체적 구분과 그 내용이 아니라 경찰제도를 누가 어떻게 운영하는가 하는 운영의 방식이라는 경찰제도의 본질을 제시하고자 한다. 그리고 새로운 경찰제도에 대한 비판적 논의를 통하여 한국의 경찰제도가 향후에 성공적으로 정착하기 위하여 나아갈 방향을 제시하였다.
