As the contracting by negotiation, which is a contract system that places importance on technology and expertise, threatens the survival SMEs engaged in the knowledge-based content industry due to the institutional contradiction in which successful bidders are selected by price competition rather than technology competition. Accordingly, it is necessary to review the direction of institutional efficiency. Therefore, this paper focused on the detailed analysis of the recent bidding and successful bids and contracts of cultural industries and related public projects according to contracting by negotiation. As a result of the analysis, it was confirmed that the current contracting by negotiation did not induce technical competition differently from the purpose of the system, and that even companies with technology had a problem that they had to make a low subscription price. Therefore, it was found that in the case of public projects such as cultural industries, where expertise and technology must be secured, measures such as securing technological discrimination when evaluating proposals and preventing excessive low subscription bids are necessary. This paper is significant in that it presents a new supplementary perspective for the efficiency of the contracting by negotiation.

기술력과 전문성을 중시하는 계약제도인 협상에 의한 계약제도가 기술경쟁 보다는 가 격경쟁으로 낙찰자가 선정되는 제도적 모순으로 지식기반의 콘텐츠 산업에 종사하는 중 소기업의 생존을 위협함에 따라, 제도 효율화 방향에 대해 검토가 필요한 상황이다. 이에 본 연구는 협상에 의한 계약에 따른 최근 문화산업 및 관련 공공사업의 입찰 및 낙찰, 계 약 관련 실태를 상세 분석하는데 초점을 맞추었다. 분석 결과, 현행 협상에 의한 계약체 결기준은 제도의 취지와 다르게 기술경쟁을 유도하지 못하고 기술력이 높은 업체조차도 기존보다 더 저가입찰을 하게 되는 문제점이 발생하고 있음을 확인하였다. 따라서 문화 산업 등의 업역에서 제안서 평가 시 변별력을 확보하고, 과도한 저가입찰을 예방하는 방 안이 필요하다는 결과를 도출할 수 있었다. 본 연구는 협상에 의한 계약제도 효율화를 위 해 새로운 보충적 시각을 제시하였다는 점에서 의의가 있다.
