Several studies have been conducted such as disabling, retribution, deterrence, and justifiable public opinion in the field of criminal punishment research. Disagreement among researchers is due to the fact that the general public's thinking about the appropriate level of punishment for criminal activities has changed. It was one of the great debates among the people in our society. This public opinion has also been reflected in various media contents such as movies, novels, and cartoons. This study aims to understand the injustice of legal punishment felt by victims of criminal cases in the media, and the implications of the public opinion. Naver webtoon, , which is serialized every Saturday, was selected as the subject of the study, based on public distrust and personal sanctions on the Korean sentencing system. After collecting a total of 129,699 online comments from episodes 1 to 90, Therefore, the trend of changes in the number of comments & likes per episode was analyzed, and the overall direction of webtoon and public perception were analyzed. Netizens showed cheers and positive responses to the appearance of the protagonist who motivated the actual case and solved the contradiction of the reality of our legal system with violence. In other words, it can be seen that people react very strongly when they touch the law feelings about “appropriateness of Korean law enforcement”, “the relationship between the perpetrator and the victim”, and “the issue of sentencing for the perpetrator”.

그동안 범죄 처벌연구 분야는 무능화, 응보, 억제, 당위적 공과론 등 각각의 견해에 대한 많은 연구들을 진행하였다. 이러한 연구자들 간의 이견은 범죄 행위에 대한 적절 한 처벌 수위에 대한 일반인들의 생각이 계속 변해왔기 때문이다. 그것은 현재 우리 사 회에서도 국민들 사이에 큰 논쟁거리 중 하나였다. 이러한 국민들의 여론은 영화, 소설, 만화 등 각종 미디어 콘텐츠에도 반영되어왔다. 본 연구는 미디어 속에서 범죄사건의 피해자들이 느끼는 법적 처벌의 불공평과 이 에 대해 국민들이 느끼는 정서 및 함축된 의미 등을 파악하고자 한다. 이를 위해, 한국 양형 제도에 대한 대중들의 불신과 사적 제재를 소재로 하여 매주 토요일마다 연재되 고 있는 네이버 웹툰, <비질란테>를 연구 대상으로 선정하였다. <비질란테> 1화부터 90화까지의 총 129,699건의 웹툰 독자 온라인 의견 수집 후, 수집된 데이터를 바탕으로 회 차별 의견량 & 공감지수 변화추이를 파악하였고 워드 클라우드를 통해 전반적인 웹툰 의 방향 및 대중의 인식을 분석하였다. 분석 결과 , 웹툰 <비질란테> 내 ‘밀양 성폭행 사건’, ‘거제 폭행 살인사건’ 등의 실제 사건을 모티브로 다룰 때 온라인 의견량 및 공감지수의 급상승을 통해 구독자들의 그 관심 정도가 매우 높아지는 것을 확인할 수 있었다. 또한 실제 사건의 모티브화와 우리 법체계 현실의 모순을 폭력으로 해결해나가는 주인공의 모습에 환호와 긍정적인 반응 을 보였다. ‘우리나라 법 집행의 적절성’, ‘가해자와 피해자 간의 관계’, ‘가해자에 대한 양형 문제’ 등에 대해 법 감정을 건드렸을 때, 독자들이 굉장히 크게 반응한다는 것을 알 수 있었다. 그 외에 범죄형태의 변화 및 양형기준에 대한 분석 결과 등을 전반적으 로 고려하였을 때, 이 논문의 <비질란테> 분석 연구 결과와 상당한 일치성이 있다는 것 을 확인할 수 있었다. 우리는 이러한 유사 사건들의 피의자들이 끊임없이 던지는, ‘우리의 법체계는 피해 자들을 충분히 보호하는가?’, ‘가해자들의 인권이 지나치게 보호되는 것은 아닌가?’, ‘반 성 없는 가해자들에 대하여 합당한 처벌을 하고 있는가?’ 끊임없이 질문하는 <비질한 테> 주인공의 딜레마를 통해 범죄학의 응보 연구의 방향성과 우리의 양형 체계에 대해 필요성을 제시하였다.
