There has been constant controversy over the ‘rightful law enforcement or excessive suppression’ of the police physical force exercise during the law enforcement process. Under such circumstances, the National Police Agency's ‘Rules on Standards and Methods for the Exercise of Police Physical Force’ were prepared last year following a raised issue of ‘uniform standards and specific guidelines for the use of physical force by police.’ However, there is controversy over the National Human Rights Commission's recommendation for disciplinary action, which judged the police officer's response to the incident as an excessive use of violence, as a dilemma for the police field. In order to find a more realistic solution to this controversy, this study seeks to present a policy alternative to supplementing the legal system currently in place through the review of relevant domestic and international legal regulations and collecting realistic opinions from actual field police officers, and, furthermore, effective practical alternatives to the limitations of field police officers' exercise of physical force.

경찰의 법집행 과정에서 발생한 물리력 행사가 ‘정당한 법집행 인가 아니면, 과잉 진 압 인가’에 대한 논란이 끊이지 않고 있다. 그러한 가운데 지난해 ‘경찰의 물리력 사용 에 관한 통일된 기준과 구체적인 지침이 있어야 한다’는 문제 제기에 따라 ‘경찰청예규’ 인 ‘경찰물리력 행사의 기준과 방법에 관한 규칙’이 마련되었다. 그러나 이에 따른 경 찰관의 현장 대응을 과도한 폭력 행사로 판단한 국가인권위의 징계 권고를 두고 경찰 현장의 딜레마라는 논란이 있다. 이 연구에서는 이러한 논란에 대한 보다 현실적인 해결 방안을 모색하기 위하여 국 내외 관련 법규정의 검토와 현장 경찰관의 현실적 의견 수렴을 통해 현재 시행되고 있 는 법제도를 보완하는 정책적 대안과 더 나아가 현장 경찰관의 물리력 행사의 한계에 대한 현장 관점의 실효성 있는 현실적 대안을 제시하고자 한다.
