20 years have passed since the launch of the DDA negotiations on fisheries subsidies in the WTO, and the 2020 deadline set under the UN Sustainable Development Goals (SDG) 14.6 has approached. At this juncture, it is necessary to examine the current status of discussions on disciplining fisheries subsidies. The progress to date has been long and slow in the WTO, but outside the WTO, at the regional level, CPTPP and USMCA have adopted fisheries subsidies disciplines into the agreements. This is significant in that it has finally been stipulated in the agreements after many years of discussion. It is worth noting that although the USMCA has been signed only three years after the conclusion of the CPTPP, the provisions under the USMCA related to fisheries subsidies complements and extends that of the CPTPP’s. In this paper, we look at the implications of these developments in the ongoing WTO Fisheries Subsidy negotiations. In particular, the study focuses on the applicability of the current WTO remedies to the new fisheries subsidies disciplines.

세계무역기구(WTO)에서 수산보조금 관련 규범협상이 개시된지 20년이 흘렀으며, 협상의 동력이 되어왔던 UN 지속가능개발목표(SDG) 14.6 상의 WTO 수산보조금협상 타결 기한인 2020년에 들어선 현시점에서 수산보조금 논의 현황에 대해 고찰해 볼 필요가 있다. 현재 WTO에서 수산보조금 논의는 지지부진한 상황이지만, WTO 밖, 지역무역협정 차원에서는 CPTPP와 USMCA가 수산보조금 규율을 채택하는 성과를 보였다. 이는 다년간의 논의 끝에 수산보조금 규율이 최초로 명문화되었다는 점에서 그 의미가 크며, CPTPP와 USMCA가 약 3년의 차이를 두고 타결되었지만, USMCA 상 수산보조금 관련 조항들이 발전된 모습을 보인다는 점을 주목할 필요가 있다. 본 논문에서는 이러한 발전 양상이 현재 진행 중인 WTO 수산보조금 협상에 가지는 함의를 살펴보았다. 특히, WTO 체제에 수산보조금 규율을 도입할 시, 현행 WTO 상 구제조치와의 적합성에 초점을 맞춰 검토하였다.
