“The doctrine of double effect” and “the doctrine of doing and allowing” distinguish moral differences concerning the acceptability of actions on the basis of intuition. Both doctrines draw conclusions that are clearly opposed to consequentialism in the context of a moral problem in which harm must be done to others to bring about an overall good. Thus, the justification of the two principles as moral theories has important significance in the theoretical success or failure of consequentialism and non-consequentialism. In this paper, I critically consider whether the two doctrines can be justified without paradox as constraints on doing harm, focusing on Foot's view of advocating the doctrines from the perspective of non-consequentialism.

이중결과의 원리와 함과 허용의 원리는 행위의 허용가능성에 관한 도덕적 차이를 직관적으로 구별한다. 타인에게 해를 입혀야만 전체적 선을 가져오는 도덕적 문제 상황에서 두 원리는 해악의 행위를 제한함 으로써 반결과주의적 결론을 도출한다. 따라서, 두 원리의 이론적 정당 화 여부는 결과주의와 비결과주의의 이론적 성패에 중요한 의의가 있 다. 본고에서는 이중결과의 원리와 함과 허용의 원리를 옹호하는 풋의 견해를 중심으로 두 원리가 해악의 행위에 대한 제약으로서 역설 없이 정당화될 수 있는지 비판적으로 고찰한다.
