The Land Use Regulation Map (LURM) is a map which combines the law with a map to determine the legal effect applicable to the range of land use regulation by means of an administrative process such as announcement. However, due to conflict between the LURM and Cadastral Map (CM) indicating the range of ownership, such legal effect is often invalidated. Therefore, such invalidation of the law threatens the reliability and stability of the law. As such, this thesis is intended to propose improvement methods that focus on legal and institutional aspects in order to protect landowners from the infringement of their property rights under land use regulation as well as to ensure that legal effect of the areas subject to land use regulation remains effective. Such improvement methods include. First, Cadastral Computerized Data (CCD) coverage and usage restrictions should be abolished. In addition, the analysis of the intellectual overlay of the Korea Railroad Corporation (KR) to verify the improvement plan showed that the cost-benefit ratio (B/C) is 16.1, which is highly economically feasible. Second, the early establishment of Digital Cadastral Map (DCM) which will be followed by a legal fiction process (One-Stop-Service) of 22 relevant laws, making it applicable to LURM. Among these, the Railroad Construction Act has been in effect since its resolution at a plenary session. As mentioned above, laws and maps are not separate any longer, but mutually supportive in development through a sustainable and new type of combination, and this work shall continue in a follow-up study.

토지이용규제지도(LURM)는 법과 지도가 결합된 것으로 토지이용권 제한범위의 고시라는 행정행위를 통하여 법의 효력을 확정하는 지도이다. 그러나 토지이용규제지도와 소유권 범위를 표시한 지적도와 서로 불일치하여 법적 효력이 취소되는 사례가 상당수 발생하여 법의 신뢰성･안정성이 위협받고 있다. 따라서 본고에서는 토지이용규제지역의 법적 효력 유지와 함께 토지소유자 및 임차인이 재산권을 침해 받지 않도록 법적 개선 방안을 제안한다. 첫째, 지적전산자료(CCD) 제공 범위 및 이용의 제한을 폐지하여야 한다. 아울러 개선안에 대한 실증을 위해서 한국철도시설공단(KR)의 지적중첩도 사례를 통해 분석한 결과 비용･편익비 (B/C)가 16.1로 경제성이 매우 높은 것으로 나타났다. 둘째, 전자지적도(DCM)를 조기 구축 후 토지이용규제지도에 사용할 수 있도록 22개 관련 법을 의제 처리하도록 한다. 물론 그 가운데 철도건설법 및 택지개발촉진법 등 의 경우 국회에서 의결되어 현재 시행하고 있다. 더 이상 법과 지도는 별개가 아니다. 따라서 새로운 형태의 결합으로 나타나게 될 것이며, 문제점을 개선, 보완･발전시킬 수 있도록 후속 연구가 이어져야 한다.
