This article intended to examine the formation process of imperial law system of Japan as analyzing the process of enactment of the universal law (共通法, 1918). As a result of this study, some findings are as follows: First, the "area where the party is belonged" in the universal law means permanent domicile(本籍) of the family register, so that Japanese, Korean, and Taiwanese were determined by ascertaining the legal domain to which their permanent domiciles were belonged. Second, the universal law was a law to preserve the status quo, supporting the imperial law system of Japan in which the Japan mainland and its colonies were separated in different legal territory. Third, there was a clear hierarchy between the Japan mainland and its colonies, including Korea. The Japan mainland, or the space where the Constitution was fully enforced, was able to deny the immigrant of colonial people, so Japanese living there could be ruled equally on a regional basis. On the other hand, the colony, which was actually a part of the Constitution, welcomed the immigrant of Japanese. When Japanese become the majority in colonies, the colonies would be transformed into Japan mainland.

본고는 조선을 중심에 놓고 공통법의 제정 과정을 분석함으로써, 이법지역과 본적이라는 공간을 매개로 사람을 구별하는 일본의 제국 법제 형성 과정을 검토하였다. 이를 통해 분명해진사실은 다음과 같다. 첫째, 공통법에서 말하는 ‘당사자가 속한 지역’이란 호적의 소재지인 본적지를 말하며, 본적지가 내지, 조선, 대만 가운데 어느 지역에 속하는지에 따라 일본인, 조선인, 대만인이 구별되었다. 둘째, 이러한 공통법은 현상을 유지하려는 법률로서, 내지와 식민지들이이법지역을 이루는 국가 시스템을 뒷받침했다. 셋째, 제국 본토인 내지와 식민지 조선 사이에는 명백한 위계가 존재했다. 헌법이 온전히 시행되는 내지라는 공간은 중국인과 식민지민의 이주를 억제함으로써 일본인 및 문명 외국인만을 대상으로 하는 속지적 통치를 표방할 수 있었고, 이미 유입된 이들을 차등 대우하는 법령을 제정할 수 있는 권한까지 보유했다. 반면 사실상 헌법 중 일부만 시행되는 공간인 식민지는 지배 민족인 일본인의 유입을 환영했다. 그들이기존 인구를 능가해 식민지에서 인구의 다수를 점할 때 비로소 식민지도 헌법이 시행되는 내지로 전환될 것이었다. 하지만 결국 조선과 조선인은 식민지(민)으로서 독자성을 유지한 채로해방을 맞았다.
