The purpose of this study is to contribute to the establishment of relevant legislative and policy directions in the future by analyzing the process and characteristics of the US federal government 's cannabis regulation and the state' s legalization of medical and marijuana use. The US federal government considers cannabis(marijuana) as a regulated drug and prohibits its use and sale, but 30 states in April 2018 have used medical use, and nine states and the District of Columbia have legalized cannabis sales. In addition, the cannabis industry is becoming a blue ocean industry. The process of legalization of the US cannabis is the result of a struggle over the past 100 years between federalism as a prohibit and decentralization as a decriminalization. In this study, the characteristics of the US legalization process of cannabis are as follows. In the process of legalization of medical cannabis, the right to pursue citizens' health, the demand for cannabis for happiness seeking rights, the impossibility of issuing cannabis prescriptions, and the sanctions and conflicts on cannabis sellers were exposed. In the process of legalizing cannabis for recreation, the federal government's ambiguous position, and the tendency to legalize cannabis for recreation in the way of petitioning the residents became clear. Based on this, in the process of legalization of US cannabis first, the court's positive interpretation of the pharmacological effects of cannabis, second, the ambiguous attitude of the federal government to regulation or permitting cannabis, third, the unity of cannabis legalization conditions, fourth, the legalization strategy and conflict of cannabis as a revenue source, fifth, the issue of control of access to marijuana by juveniles was identified. Therefore, South Korea should also prepare a cannabis strategy that takes into account the rights of the individual to pursue happiness, the right to pursue happiness, and the health and health responsibilities of the nation, based on changes in the attitude of the United Nations on medical cannabis and the legalization of Canada and the United States. And overall social discussion, policy diagnosis, and legislative maintenance are needed.

이 연구의 목적은 미국 연방정부의 대마초 규제법 및 주정부의 의료용 및 기호용 대마초의 합법화 과정 및 특징, 그리고 주요 쟁점을 분석함으로써 향후 한국의 관련 입법 및 정책 방향설정에 기여하는 것이다. 미국 연방정부는 대마초, 즉 마리화나를 규제약물로 간주하고 그 사용 및 판매 등을 금지하고 있지만, 2018년 4월을 기준으로 30여개 주는 의학적 사용을, 그리고 9개 주와 콜럼비아 특별구는 기호용 대마초 판매 등을 합법화하였다. 또한 미국의 대마초산업은 블루오션 산업으로 자리잡아가고 있다. 미국의 대마초 합법화의 과정은 연방정부의 대마초 금지를 표방한 연방주의와 대마초 합법화주의를 주장하는 주정부들의 분권주의의 100여 년에 걸친 투쟁과정의 연장선상에 있다. 미국의 대마초 합법화 과정에서의 특징을 살펴보면 다음과 같다. 의료용 대마초의 합법화 과정에서는 시민의 건강추구권, 행복추구권적 차원의 대마초 수요, 대마초 처방전 발급 불허와 반발, 대마초 판매자에 대한 제재와 갈등이 노출되었다. 기호용 대마초의 합법화 과정에서는 연방정부의 불명확한 입장, 주민청원 입법 방식의 합법화 경향을 뚜렷하게 보였다. 이를 바탕으로 미국의 대마초 합법화 과정에서 첫째, 대마초의 약리적 효과에 대한 법원의 긍정적 해석, 둘째, 대마초 규제 또는 허용에 대한 연방정부의 모호한 태도, 셋째, 기호용 대마초 합법화 조건의 통일성 문제, 넷째, 주정부의 수입원창구로서의 대마초 합법화 전략과 갈등, 다섯째, 청소년의 대마초 접근에 대한 통제 문제 등의 쟁점이 확인되었다. 따라서 한국 역시 의료용 대마초에 대한 유엔의 태도 변화 및 캐나다와 미국의 합법화 전략 등을 바탕으로 개인의 건강권과 행복추구권 그리고 국가의 국민에 대한 건강보건책무 등을 고려한 대마초 전략을 준비해야 한다. 그리고 이에 대한 전반적인 사회적 논의와 정책진단, 그리고 입법정비 등이 필요하다.
