The superficies is devided into 2 superficies, which are the statutory superficies and the common-law superficies, in Korea Civil Act. The statutory superficies is regulated in § 279 of Korea Civil Act. But the content of the common-law superficies is not found in Korea Civil Act, because this superficies bases on the common-law. Therefore the content of the common-law superficies has to be confined through the case law. The common-law superficies exists, when at first the land and the building on this land belong to a person, and then base on the sale or the others legal sources the owner of the land and the building is seperated, if there is no option which contains the demolish of the building. In other words, in this case the owner of the building has continuously a right(the superficies) of using the land in case law. Thus, the first a person who has the ownership of the land and the building, secondly the ownership of the land and the building is seperated, third non-option of the demolish of the building between parties. In this case the common-law superficies don’t need the registration in real estate registration paper. Hence, the common-law superficies is called as “the case-law superficies”. But in the common-law superficies exists a little problem. Are there the confidence power of this custom and the custom about the superficies, before the Supreme Court confirms the common-law superficies? Unfortunately, this can’t be confirmed in case law. Until now, Korea cases on the common-law superficies in Supreme Court are many. Finally, the common-law superficies need to be regulated in the related act.
