According to Sociologist Esping Anderson, the greatest aim of social welfare policy lies in protecting humans from the cries of life. (1990) Social welfare policy, along with family and local community, is a safety net minimizing crises in life. Although Korean society is entering a highly industrialized phase, its social welfare policy is based on the traditional extended family, the disruption of which serves as an obstacle to the advancement of social welfare. As the population continues to age, Korean society-having formerly included many “aged ones”- is entering a phase in which society includes many “very old people of great age.” This trend affects the demographics of domestic prisons as well as it does the demographics of other social welfare programs. This increase in elder-perpetrated crimes is leading to a rise in the number of older inmates. In consequence, a policy agenda for treating them is emerging as a main concern of correctional authorities along with social welfare expert’s concerns regarding ensuring the welfare of an aging society.

에스핑 앤더슨은 사회보장정책의 최대의 목적은 인간들을 생활의 위기로부터 방어를 하는데 있다고 하였다. 사회보장정책은 과거의 가족이나 지역공동체와 같이 생활 위기를 최소화 하는 안전망이다. 대한민국은 고도산업사회에 진입하고 있으나 사회보장의 기초는 보수주의적인 가족주의에 기반을 두고 있기 때문에 사회보장발달에 장애 요인으로 작용하고 있다. 우리사회가 ‘고령화 사회’를 넘어‘초 고령 사회로’로 가면서 국내 교도소 역시 고령화라는 시대 흐름을 피하지 못한 것으로 밝혀지고 있다. 문제는 고령재소자의 급증이 한국사회 고령화 속도보다 더 빠르다는 것이다. 불과 10년 사이에 인원과 비중 면에서 3배 넘게 급증하였다. 여기에 경제적 불황이 장기화 되면서‘차라리 죄를 짓고라도 교도소에 들어가겠다.’면서 마음먹고 실제 행동으로 옮기는 노인도 적지 않다는 것이다. 이러한 노인범죄의 증가는 결과적으로 노인수형자의 증가를 가져오고 있으며, 노인수용자에 대한 처우는 고령화 사회와 더불어 교정당국에서는 주요한 현안으로 제기되고 있다.
