The purpose of this study was to enhance the understanding of psychological and social characteristics of the juvenile sexual offenders on probation by conducing in-depth analysis of the structure and process of the experiences that the juvenile sexual offenders on probation have as time passes from the time when sexual violence acts are exposured to the time that the legal proceeding of probation is ended. Based on the results of analysis Using the methods suggested by Strauss and Corbin’s Grounded theory, 145 concepts 59 sub-categories, and 25 categories have eventually been specified. A paradigm model was proposed as fellows. 1) ausal conditions : thinking that the incident began with the victim, thinking that they did not think they would receive the legal punishment before they were exposured, thinking that they received punishment because of biased social perspective. 2) ontext conditions : Making friends through sex, possessing fractional sexuality stereotype, becoming insensitive to trifle delinquencies, perceiving the incident as play with friends. 3) entral phenomenon : not knowing what to do although they have resentment, wanting to erase the incident from their mind. 4) ntervening conditions : feeling sorry, parents’ defending and covering up, getting people’s looking at them as sex offenders, perceiving ‘my responsibility’ to a limited extent, wanting to avoid repeated punishment and additional punishment. 5) Action-interaction strategy : recognizing the incident to avoid punishment, being relieved and compliant with probation being granted, repenting ‘my behavior’ in the incident process, shutting off eyes from the surroundings and hiding, erasing the tag of sex offender, regarding careful sex, limited changes in attitude toward sex started with the process of the incident, setting up self-protection rules 6) Consequences : with resentment still remaining, putting significance to the incident and going on forgetting, living within the social framework, living in the reality that is high to face The core category in the experiences of the experience process of the juvenile sexual offenders on probation was 'Despite chagrin, giving meaning to the incident and escaping from it’ Participants went through seven stages with time in their experience process : the stage of facing confusion, the stage of evasion of responsibility, the stage of avoiding punishment, the stage of psychological resistance, the stage of self- normalization, the stage of strategic reestablishment, and the stage of conforming to reality. The findings of this study suggested that prudent evaluation and the medium and long-term social intervention for the juvenile sexual offenders are needed to prevent them from committing repeated delinquency and to lead them to live as the members of society.

본 연구는 성폭력으로 보호관찰 처분을 받은 청소년들이 가해행위의 적발 시부터 법 적 처분인 보호관찰이 종료되는 시점까지 시간 경과에 따라 어떠한 경험을 하고 그 경 험의 구조와 과정을 Strauss와 Corbin의 근거이론 방법을 활용하여 심층적으로 분석하였다. 이 연구의 참여자들은 성폭력으로 보호관찰을 받은 청소년들로 2015. 4.부터 2015. 10.까지 보호관찰이 종료된 12명이며, ‘성폭력으로 보호관찰 처분을 받은 청소년의 경 험은 어떠한가?’라는 연구 질문을 중심으로 심층면접과 참여관찰을 실시하였다. 자료 분석 결과 개방코딩에서 145개의 개념, 59개의 하위범주, 25개의 범주를 도출하 였고, 근거이론의 패러다임 모형에 따라 실시한 축 코딩에서는 다음과 같은 6가지의 구조로 분석되었다. 1)인과적 조건 : 피해자로 인해 사건이 발단되었다고 여김, 적발전까지 법적 처벌을 받을 것이라고 생각하지 않음, 한쪽에 치우친 사회적 시각으로 처벌을 받음, 2)맥락적 조건 : 성을 통한 친구사이 연결 짓기, 단편적 성 관념 보유하기, 사소한 비행에 둔감해짐, 사건을 친구와의 놀이로 인식함, 3)중심현상 : 억울하지만 어찌할 바를 모른 채 그 사건을 지우고 싶음, 4)중재적 조건 : 면목 없음, 부모의 감싸 덮어주기, 성폭 력범이라는 시선을 받음, 제한적으로 내 책임 인식하기, 반복처벌과 가중처벌을 피하고 싶음, 5)작용-상호작용 전략 : 처벌 모면을 위해 사건 인정하기, 보호관찰 처분에 안도하고 순응하기, 사건 과정에서 내 처신을 후회함, 주변 시선 차단하고 숨기, 성폭력범이라 는 꼬리표 지워내기, 조심해야할 성으로 바라보기, 사건화 과정에서 비롯된 제한적 성태도 변화, 자기보호 규칙 세우기, 6)결과 : 억울함이 남아 있지만 사건에 의미 부여하며 잊어가기, 사회 틀에 벗어나지 않고 지내기, 마주하기에 높은 현실에서 살아감으로 나타 났다. 선택코딩에서의 핵심범주는 ‘억울하지만 사건에 의미 부여하며 벗어나기’로 나타났다. 성폭력으로 보호관찰 처분을 받은 청소년의 경험 과정은 혼란 직면 단계, 책임 회피 단계, 심리적 저항 단계, 처벌 모면 단계, 자기 정상화 단계, 전략적 재정립 단계, 현실 맞 춰가기의 7단계로 분석되었다. 본 연구 결과는 성폭력으로 보호관찰 처분을 받은 청소년의 경험 과정에 대해 살펴봄 으로써 성폭력 가해 청소년의 특성을 이해하기 위한 기초자료를 제공하며, 성폭력 가해 청소년이 재범하지 않고 사회 구성원으로서 적응적으로 살아가도록 법적 처분 과정에서 이들에 대한 신중한 평가와 함께 중․장기적인 사회적 개입이 필요하다는 것을 제시하였 다는 점에서 의의가 있다.
