Solar right is one of the basic elements of residential condition and must be considered in the process of planning, construction of buildings and urban areas. But recently in Korea, legal conflicts concerning this matter arose frequently. The goal of this study is to find the basic causes of this tendency, thus related legal system was reviewed and the actual case fields were chosen and analyzed by using solar light simulation methods. As a result, it was found that the issues of solar right had been continuously weakened in building codes, and the legal control over this matter had been transferred to civil laws regarding solar right as one of property rights, not a spatial quality matter. Also it was found in the case fields that the regulations established in the past was unsuitable in many ways to the present residential conditions and urban development tendency. These findings mean that the public laws on spatial planning need to have the function of detecting solar right damage before construction, and building codes and urban planning laws should be restructured to have the control over spatial quality concerning solar right.

일조권은 주거환경의 가장 기본적 요소 중 하나로 건축물과 도시의 계획과 조성에 있어 사전적으로 고려되어야 할 요소이다. 최근 우리나라에서 일조와 관련된 법적 분쟁이 많아지고 있어 관련 제도들에 대한 전체적인 고찰과 실제 분쟁사례 분석을 통해 그 원인을 살펴보았다. 건축법 등 공간계획 관련법령과 민법 등 각종 법령을 살펴볼 때 건축물의 일조에 대한 문제가 점차 공법의 영역에서 재산권을 다루는 민사법상의 영역으로 이동해온 경향을 볼 수 있으며, 공법의 규정이 점차 취약해져가는 가운데 법적 분쟁은 계속 증가해가는 추세를 보이고 있어 문제가 되고 있다. 또한 분쟁사례들을 분석해본 결과, 고층화되어가는 건설 경향상 과거의 규정들이 상당부분 의미를 잃고 있는 가운데, 일조의 도시계획적인 측면을 다루는 규정이 미비한 문제점들이 발견되었다. 우선적으로 일조문제를 사전에 감지하고 예방하는 공법의 기능이 먼저 회복되어야 할 필요가 있으며, 이에 따라 공간계획과 관련된 법령들이 현재 일조문제 상황을 감안하여 전체적인 개편이 있어야 할 것이다.
