- The Commercial Lease Protection Act has various inherent problems, so this study discusses the positive effects of the amendments and the feasibility of their application in the working level. The new amendments have various benefits and drawbacks with the possibility of controversies as they admit the foregift within the scope of law and include in the legislation its substantial description. In case of commercial properties with existing foregift, landlords are like to increase the monthly rent as much as possible when renewing the lease agreements. As a result, the legalization of foregift might only increase the burden for the tenants without resolving the problems behind the Yongsan case.
