Recently, the Broadcasting Performance Evaluation Code of total TVProgramming Cable Channels has been implemented for the purpose of qualitativeimprovement and ensuring public responsibility of broadcasters inRepublic of Korea. However, lots of arguments have been raised that there aretoo many indices in the Broadcasting Performance Evaluation Code and resultingcomplexity hinders the understanding an essential core of the system. This happens also in the total TV Programming Cable Channels, especiallyin the area of broadcast programming. Therefore, now, the way to understandthe legal Characteristics of Broadcasting Programming Regulations has an essentialquestion to be answered to the Constitutional meaning of the freedom ofBroadcasting. This study seeks to review past previous studies, which have exploredthe limited aspect of this issue and apply the principle of the prohibitionof excessive restriction to evaluate the Constitutionality of the BroadcastingProgramming Regulations. This Article also deprive the new and variousPurposes of the Broadcasting Programming Regulations. Finally, the study concludeswith the suggesting the new and practical solutions to enact theBroadcasting Programming Regulations

본 연구에서는 종합편성 케이블TV 방송사업자의 편성영역을 중심으로 방송평가 개선 방안에대해 살펴봤다. 방송 평가제 도입 10여 년이 지난 이후 종합편성 사업자의 보도/교양 프로그램의 과다한 편성 비율로 인해 주목받게 된 방송평가제의 문제점과 관련해 방송평가가 방송 사업자의 프로그램 편성에 어떠한 영향을 미치고 있는지 방송평가 편성영역을 중심으로 살펴보고,방송평가 편성영역의 평가항목/기준/척도가 논란이 되는 종편사업자들에게 실제로 어떻게 적용됐는지 분석했다. 마지막으로 본 연구에서는 이러한 결과를 바탕으로 종합편성케이블 TV 사업자들을 대상으로 논란이 되는 방송평가 편성영역 평가문제 개선방안을 제안했다. 연구 결과 종합편성케이블TV 사업자를 대상으로 한 편성영역 평가항목 중 관련법에서 다루고자 하는 목적/취지에 부합하지 않는 항목(예: 자체제작 프로그램 편성실적)이 확인됐다. 그리고 이 평가 항목으로 인해 비용이 적게 들뿐만 아니라 구매가 아닌 자체제작 편성실적에 속하는 보도/시사 프로그램을 과도하게 편성될 수 있다는 점이 지적됐다. 다음으로 6개의 평가항목 중 5개가 지상파TV 사업자와 같은 평가 항목을 유지하고 있지만 평가 기준과 척도에서 지상파 TV 사업자 보다완화된 기준을 적용하고 있음이 확인됐다. 마지막으로 현행 방송평가 제도는 방송통신위원회 심의사항과 규정 위반에 대한 이행여부를 주로 반영하는 행정평가 형식을 띠고 있어 변별력 문제가 있음이 확인됐다.
