The use of riot control agents has been increased because of frequent mass demonstrations. Also the possession of gas spray increased because of insecurity due to an increase in crime. In this study, the author examined the legal regulations for law enforcement (police, etc.) using such agents and for the possession of gas spray, and the politics of pepper spray possession in some countries. Under The Chemical Weapons Convention, each state party undertakes the decision to not to use riot control agents (RCAs) as a method of warfare. However, it is not prohibited for law enforcement to use riot control agents for domestic riot control purposes. Police must make public information about the tear substance such as the solvent name, usage, as well as clinical trials results and MSDS (Material Safety Data Sheet). Though the law revision stopped the production of the tear gas pistol, the color of the tear gas pistols already in the market should be changed so that they are easily noticed by people. The test also must be required for a physical-type gas spray by an accredited institution.

각종 집단민원으로 인한 시위진압과 범죄의 증가로 인한 불안감으로 자위방범을 위한 최루가스의 사용 및 가스분사기의 휴대가 증가하고 있다. 본 연구에서는 우리나라의 경찰과 일반인이 최루제 및 가스분사기 소지와 관련된 법적인 근거를 알아보았다. 아울러 영미법계와 대륙법계로 나누어 해외 각국의 입법 실태를 살펴보았다. 또한, 국제적으로 시위 진압을 위한 경우를 제외하고 전쟁 상황에서 폭동진 압제의 사용을 금하고 있어 이에 대한 국제법적 규제와 관련 국내법을 살펴보았다. 경찰에서 사용하는 최루가스에 대하여는 최루성 물질 및 용매의 물질명, 사용량, 임상실험 결과 및 물질안전보건자료(MSDS) 등을 고시를 통해 국민들이 알 수 있도록 하여야 할 것이다. 법규의 개정으로 총기형태의 가스분사기 생산은 중지되었으나 이미 출고된 가스 발사총에 대하여는 색상을 눈에 띄게 개선하고, 소지허가를 받지 않고 물리적 방법에 의해 발사되는 pepper spray에 대해서도 총포화약 안전기술협회 등 관련 검사기관의 인증을 받은 물품에 한하여 판매가 이루어져야 할 것이다.
