The certificates of origin prove that the goods they accompany have fulfilled the origin requirements set out in the law. There are two kinds of certificate of origin, non-preferential certificate of origin and preferential certificate of origin. The system of rules of non-preferential certificate of origin are based on the Foreign Trade Act, rules of preferential certificate of origin are diversified and scattered in various type of laws such as Customs Act, Foreign Trade Act and FTA Implementation Customs Law, etc. This paper found the major differences of rules and legal conflicts in the complex legal structures. The additional costs in the issuance process of certificate of origin come into being as a result of them and they have made the customs authorities investigation of the certificate of origin difficult. Because Korea needs a single legal structure, it must establish a separate law for the certificate of origin and rules of origin from Customs Act, Foreign Trade Act and FTA Implementation Customs Law.

원산지증명서가 종류별로 근거법령, 발급기관, 절차가 상이하여 수출기업이 FTA 등의 특혜관세를 이용하는데 장애요인으로 작용하였다. 본 논문은 기존의 연구를 토대로 특혜원산지증명서와 비특혜원산지증명서를 포함하여 원산지증명서가 여러 법령에 분산됨에 따른 문제점과 개선방안을 제시하여 무역관리의 효율성을 증대시키고자 한다. 원산지인증수출자제도의 확대적용, 원산지증명서 발급신청서 기재내용의 간소화 , 원산지증명서식의 통합, 원산지확인서와 수출용원재료 원산지확인서의 통합, 수출신고 취하시 발급된 원산지증명서 회수제 실시, 원산지 검증과 관련된 규정을 관세법으로 일원화, 원산지증명에 대한 세관확인 권한의 명확화 등을 원산지증명서 발급제도의 단기 개선방안으로 제시하였고, 관세청장의 관리 감독권 확보, 일반수출원산지증명서 발급기관의 이원화를 원산지증명서 발급기관에 관한 중기 개선방안으로 또한 독립된 원산지 관련 법률 제정 방안을 제시하였다.
