1987년의 민주화는 한국 현대사에 절차적 법치주의를 제도화한 분수령이었 으나, 오늘날의 법은 권력과 자본의 통제 기술로 전락하여 실질적 정의를 담보 하지 못하는 헌정주의의 역설을 노정하고 있다. 이 글은 87년 체제 전후를 배경 으로 한 한국의 문학과 영화가 실정법(droit)과 정의(justice)의 아포리아적 괴 리를 어떻게 서사화하고, 파괴된 공동체의 윤리를 재구성하는지 분석한다. 이를 위해 법의 절대적 공백 속에서 자행된 야만을 그린 영화 〈남산의 부장들〉, 신자 유주의하에서 법과 폭력이 관료적 자동기계로 타락한 세계를 묘사한 소설 『설 계자들』, 기만적 법정 안에서도 형평성을 무기로 내재적 투쟁을 벌이는 영화 〈행복의 나라〉를 교차 독해한다. 세 텍스트는 법의 부재, 도구화, 내재적 고투 라는 층위에서 폭력과 윤리의 연대기를 증언한다. 결론적으로 서사 예술은 합법 성이 배제한 타자의 고통을 감각적으로 복원함으로써, 형식적 법치를 넘어 타자 를 향한 책임과 연대로 결속되는 참된 정의의 공동체를 미학적으로 선취함을 밝힌다.

The democratization of 1987 marked a watershed moment that institutionalized the procedural rule of law in modern Korean history. However, contemporary law has increasingly degenerated into a technology of control for power and capital, exposing the paradox of constitutionalism failing to guarantee substantive justice. This study examines how Korean literature and film since the 1987 regime have narrativized the aporia between positive law (droit) and absolute justice (justice), thereby reconstructing the ethics of a shattered community. To this end, this paper conducts a comparative analysis of three texts: the film The Man Standing Next (2020), which depicts the barbarism committed in the absolute void of law; Kim Un-su’s novel The Plotters (2010), which portrays a neoliberal world where law and violence have deteriorated into a bureaucratic automaton; and the film Land of Happiness (2024), which illustrates an immanent struggle utilizing legal equity as a weapon even within a deceptive courtroom. These texts testify to a chronicle of violence and ethics across the strata of the law’s absence, its instrumentalization, and the immanent struggle within it. Ultimately, this paper demonstrates that narrative arts sensuously restore the pain of the Other excluded by legality, aesthetically prefiguring a community of true justice, bound by absolute responsibility and solidarity toward the Other beyond the formal rule of law.
