중국에서 차이리(彩礼)는 오랜 역사를 지닌 전통 혼인풍습(婚俗)으로, 그 핵심은 ‘두 가문의 화합(合二姓之好)’이라는 윤리사상이 깃든 예의 상징성이 있다. 그러나 사회 전환기, 특히 농촌의 성비 불균형과 시장경제 가치관의 침투로 인해 차이리 관습은 심각한 이질화 현상을 겪게 되었다. 차이리의 본질인 ‘예(禮)’라는 정신적 내핵은 점차 사라지고, ‘이(利)’라는 물질적 속성이 전례 없이 부각되었다. 이는 구체적으로 액수의 ‘천가화(天價化, 터무니없이 높은 가격)’, 기능의 ‘경쟁화’, 성격의 ‘거래화’로 나타난다. 이러한 차이리의 변질은 가계 부담을 가중시키고, 혼인의 본질을 왜곡하고 있다. 이러한 현상에 대해 중국법은 오랫동안 ‘소극적 인정’ 전략을 취하며, “혼인을 빙자 하여 재물을 요구하는 것을 금지한다.”는 원칙적 규정만을 두었다. 반면, 민간 관습은 전통문화의 관성에 따라 차이리를 지속적으로 적극 강화해 왔으며, 이 두 지점은 규범 적 모순을 형성한다. 이에 대해 최고인민법원은 사법해석을 통해 제한적인 보완책을 마련해 왔다. 그러나 2024년 ｢차이리 분쟁 사건 심리 시 법률 적용의 약간 문제에 관한 규정｣은 ‘사전 규제’ 가 아닌 ‘사후 반환’에만 초점이 맞춰져 있다. 차이리 반환의 법리적 기초는 ‘해제조건부 증여설’에서 사회적 실천 배경에 더 부합 하는 ‘목적적 증여설’로 전환되어야 한다. 즉, 차이리는 ‘안정적인 공동생활의 수립 및 유지’를 근본 목적으로 하는 재산 급부로 보아야 한다는 것이다. 약혼 파기나 짧은 혼인 기간 등의 사유로 이 목적이 달성되지 못했을 때는 부당이득에 기초한 반환청구권이 발생한다. 따라서 실체법과 절차법 양면에서 차이리 반환이 개별 사례에 맞게 형평성 을 갖추도록 보장함으로써, 차이리가 ‘이익(利)’에서 ‘도리(理)’로 최종적으로 회귀할 수 있도록 유도해야 한다.

彩礼在中国是一项源远流长的传统婚俗，其核心为承载“合二姓之好”伦理的礼仪象 征。然而，伴随社会转型，特别是农村性别比失衡与市场经济价值观渗透，彩礼实践发 生了深刻异化。其“礼”的精神内核逐渐消解，“利”的物质属性空前凸显，具体表现为数 额“天价化”、功能“竞争化”与性质“交易化”。彩礼的异化为加重了家庭负担，扭曲婚姻 本质。面对此现象，国家成文法长期采取“消极承认”策略，仅原则性规定“禁止借婚姻 索取财物”，而民间习惯则在传统文化的惯性下持续“积极强化”，二者形成规范矛盾。 对此，最高人民法院通过司法解释进行了有限补位。但以2024年《关于审理涉彩礼纠纷 案件适用法律若干问题的规定》为代表的司法解释，仅能聚焦“事后返还”而非“事前规 制”。彩礼返还的法理基础应从“附解除条件赠与说”转向更契合社会实践背景的“目的性 赠与说”，即彩礼是以“建立并维持稳定共同生活”为根本目的的财产给付。当此目的因 婚约解除或婚姻短暂存续等原因落空时，产生基于不当得利的返还请求权。应从实体和 程序上保障彩礼的返还符合个案衡平，引导彩礼从“利”向“理”的最终回归。

Betrothal gifts are a long-standing traditional wedding custom in China, with the core being a symbol of etiquette that carries the ethics of “uniting the interests of the two families”. However, with social transformation, especially the gender imbalance in rural areas and the infiltration of market economy values, the practice of betrothal gifts has undergone profound alienation. The spiritual core of its “ritual” has gradually dissolved, while the material attribute of “interest” has been unprecedentedly prominent, specifically manifested as “overpriced” amounts, “competitive” functions and “transactional” natures. The alienation of betrothal gifts has increased the burden on families and distorted the essence of marriage. As for such phenomenon, China’s statutory law has long adopted a “negative recognition” strategy, merely stipulated in principle that “exaction of properties in connection with marriage is prohibited”, while in practice, driven by traditional culture, betrothal gifts have been continuously “positive reinforced”, which have formed a normative contradiction. In response to this, the Supreme People’s Court made limited filling through judicial interpretations. However, judicial interpretations such as the Provisions on Several Issues Concerning the Application of Law in the Trial of Cases Involving Betrothal Gift Disputes in 2024 only focuses on “post-event return” rather than “pre-event regulation”. The legal basis for the return of betrothal gifts should shift from the “gift theory with subsequent condition” to the “purposeful gift theory” that better aligns with the background of social practice. Specifically, the betrothal gifts are property payments with the fundamental purpose of “establishing and maintaining a stable shared life”. When this purpose fails due to reasons such as the dissolution of the engagement or the brief existence of the marriage, condictio indebiti based on unjust enrichment arises. It is necessary to ensure that the return of the betrothal gifts conforms to the equity of individual cases from both substantive and procedural aspects, and guide the ultimate return of betrothal gifts from “interest” to “rationality”.
