Currently, the asset management industry is still facing hidden systemic risks such as “shadow banking”, multi-layer nesting and rigid redemption in the process of gradual standardization. Therefore, as a fundamental law for the prevention of financial risks in China, the FSL is of great significance to the healthy development of the asset management industry by systematically building a new pattern of financial stability and strengthening the framework system for early-warning, prevention, resolution and disposal of financial risks. The formulation and implementation of the FSL should always adhere to the two principles, one is improving the legal norm system in the asset management industry, and the other is the market-resolution-first principle for risk mitigation. Only in this way can scientific legislation be achieved. Based on this as a standard, the current institutional framework of the FSL still needs to be improved in the regulation of the asset management industry. Firstly, the coordination of the legislative system is insufficient, and there are institutional conflicts with China’s Company Law and China’s Enterprise Bankruptcy Law, etc., which highlights the problems of procedural convergence and supporting system design. Secondly, the protection mechanism for the investors of asset management business is weak. The existing legal positioning and regulatory standards are not clear enough, and the mechanism for right protection is still unsound. Thirdly, the response to digital risks is lagging behind, and there is a lack of targeted regulations on algorithm-driven businesses such as smart investment advisors and quantitative trading. These issues need to be addressed and strengthened. In order to optimize the implementation efficiency of the FSL, it is not only necessary to start with the collaborative optimization of internal and external systems to achieve coordination in the content of laws and regulations, but also necessary to accelerate the construction of supporting mechanisms from the aspects such as financial risk early-warning and financial protection funds in the asset management industry. With the deepening implementation of the FSL and the continuous improvement of supporting mechanisms, the asset management industry will gradually advance towards a more standardized and transparent development track. In the future, it is necessary to further study the path of rule of law, coordinate risk prevention and market innovation, achieve a benign interaction between financial stability and the development of real economy, and lay a solid foundation for building a more resilient modern financial system. Under the protection of the rule of law, the asset management industry will become an important force in serving the real economy and promoting common prosperity.

현재 자산관리 산업은 점진적으로 규범화되고 있음에도 불구하고, 이른바 ‘그림자 은행(影子银行)’화, 다층 구조, 경직된 상환 등 시스템적 위험 요소에 직면해 있다. ｢금융안정법｣은 중국 금융 리스크 방지의 기초적인 법률로서, 시스템을 통해 금융 안정의 새로운 구도를 구축하고, 자산관리 업계의 금융 리스크 경고, 예방, 해결, 처리 의 프레임워크 체계를 강화하는 것은 자산관리 업계의 건강한 발전에 중요한 의미를 갖는다. ｢금융안정법｣의 제정과 시행은 항상 자산관리 업계의 법률규범체계 완비 원 칙과 시장 지원 우선의 위험 해소 원칙을 고수함으로써 과학적 입법이 실현될 수 있다. 이러한 기준으로 살펴볼 때, 현재 ｢금융안정법｣의 제도적 틀은 자산관리 산업의 규범화 과정에서 여전히 보완이 필요한 부분이 존재한다. 첫째, 입법체계의 조율이 부족하여 ｢회사법｣, ｢기업파산법｣ 등과 제도적 충돌이 존재하며, 절차 연계 및 보완 제도의 설계에서 문제가 두드러진다. 둘째, 자산관리업무의 투자자 보호 메커니즘이 취약하고, 현행법 상의 지위 및 감독 기준이 명확하지 않아 권리구제체계도 아직 미 비하다. 셋째, 디지털 리스크 대응이 지연되어 스마트 자문, 알고리즘 기반의 양적 거래 등 알고리즘 주도형 업무에 대한 구체적 규범이 부족하다. ｢금융안정법｣의 시행 효율성을 최적화하기 위해서는 내외부 체계의 협력 최적화 뿐만 아니라, 법률과 규정의 내용에서도 조화를 이루어야 한다. 자산관리 산업의 금 융 위험 경고, 금융 보장 기금 등의 측면에서 지원 메커니즘 구축을 가속화할 필요가 있다. ｢금융안정법｣의 심화 추진과 지원 메커니즘의 지속적인 완성에 따라 자산관리 산업은 점차 더 규범적이고 투명하게 발전할 수 있을 것이다. 미래에는 법치화 방안 연구를 통해 리스크 방지와 시장 혁신을 통합적으로 추진하고, 금융 안정과 실물경제발전의 선순환을 실현하여 더 탄력적인 현대 금융시스템을 구축하는 데 견고한 기초 를 마련해야 한다. 법치 보장 하에 자산관리 산업은 실물경제를 지원하고, 공동부유 (共同富裕)를 돕는 중요한 동력이 될 것이다.
