Against the backdrop of the deepening U.S. “Cognitive Domain Operations” (CDO) against China, the advancement of its ideological alliance strategy exhibits increasingly distinct legalized and institutionalized characteristics. By extending the extraterritorial application of domestic laws, coordinating legal frameworks among allies, and shaping international rules, the US methodically shapes allied policies across political, security, economic, and technological spheres, thereby placing South Korea in a “strategic dilemma.” South Korea faces significant compliance risks and sovereignty constraints due to the tension between fulfilling legal obligations within the alliance and preserving its strategic economic autonomy. In response to this structural pressure, South Korea has adopted a composite strategy leveraging legal and institutional space: employing “strategic ambiguity” regarding key issues to retain policy autonomy; pursuing differentiated cooperation through “domain-specific” approaches under various international rule frameworks; and enhancing strategic resilience via domestic legislation and independent technical standard development. These measures potentially signal, at a legal level, an openness to pragmatic cooperation with China. China-South Korea strategic interactions should transcend traditional geopolitical competition and transition to establishing a rules-based legal and institutional framework. This can be achieved by expanding bilateral engagement within frameworks such as international law and regional rules, strengthening legal and institutionalized cooperation, and deepening rules-based collaboration in third-party markets. These efforts would contribute to building a sustainable stabilizing mechanism for bilateral relations. Legal-framework-based interaction offer a critical pathway for both countries to explore a stable, predictable, and mutually beneficial model in response to the pressures exerted by the US ideological strategy.

오늘날 미국의 대(對)중국 ‘인지영역 전략(CDO)’이 지속적으로 심화되고 있다. 이 러한 배경에서 미국의 대중국 이념동맹 전략은 점점 ‘입법화’와 ‘메커니즘화’의 뚜렷한 특징을 드러내고 있다. 미국은 국내 입법의 역외 효과, 동맹 법체계 및 국제규칙 형성 을 통해 정치, 안보, 경제, 과학기술 분야에서 동맹국들에게 체계적인 정책을 요구하 였고, 이로 인해 한국을 ‘틈새 딜레마’에 빠뜨리고 있다. 한국은 한미동맹의 법적 의무 이행과 자국의 전략적 경제 자주성 유지를 놓고 심각한 준법적 충돌에 직면해 있다. 이러한 구조적 압박에 대응하기 위해 한국은 법률과 제도를 기반으로 한 다중 전략 을 채택했다. 즉, 한미동맹과 한중관계에 대한 주요 의제에서 ‘전략적 모호성’을 활용 하여 법률과 정책의 자율성을 유지하고, ‘분야 특이성’ 협력을 통해 다양한 국제조약 의 틀 내에서 차별화된 대중국 협력 경로를 모색하며, 국가 입법 및 기술표준 자율화 를 통해 전략적 탄력성을 강화했다. 이러한 전략은 제도적 측면에서 중국과의 실질적 인 협력을 모색하겠다는 잠재적인 신호이다. 한중관계의 전략적 상호작용은 전통적인 지정학적 게임을 넘어 국제조약에 기반한 법률 및 제도화로 전환할 수 있다. 이로 인해 (1) 다자간 무역체계를 공동으로 유지하 고, (2) 양자 간 투자 및 무역협정을 개선하며, (3) 기술표준의 상호 인정을 촉진하고, (4) 국제조약에 기반한 제3자 시장협력을 심화함으로써 한중관계에 지속 가능한 ‘안 정장치’를 구축할 수 있다. 이처럼 법체계 하의 한중 간의 연계와 협력은 양측이 어려 움 속에서 안정적이고 예측 가능하며, 상호 이익이 되는 관계 모델을 탐색하는 데 중요한 돌파구를 제공할 것이다.

在美国对华“认知领域作战”(CDO)持续深化的背景下, 对华意识形态联盟战略的推 进, 日益呈现出“法律化”与“机制化”的鲜明特征。 美国借助国内立法域外效力、 联盟法律 体系及国际规则塑造, 在政治、 安全、 经济与科技领域对盟友进行系统性政策渗透, 致使 韩国陷入“夹缝困境”。 韩国在履行联盟法律义务与维护本国战略经济自主之间面临严峻 的合规性冲突与主权约束。 为应对此结构性压力, 韩国采取了一套基于法律与制度空间的复合策略：在关键 议题上运用“战略模糊”以保留法律与政策的自主性, 通过“领域特异性”合作在不同国际 规则框架下寻求差异化的对华合作路径, 并通过国立法及技术标准自主化建设增强战 略韧性。 这些策略在制度层面释放出寻求与中国务实合作的潜在信号。 中韩战略互动可以超越传统地缘政治博弈, 转向构建基于规则的法律与制度化路 径。 可通过共同维护多边贸易体系、 升级双边投资与贸易协定、 推动技术标准互认及深 化第三方市场基于国际规则的合作, 为两国关系建立可持续的“稳定器”。 法律框架下的 对接与合作, 为双方在困境中探索稳定、 可预测且互利的关系模式提供了关键出路。
