교사의 아동성폭력은 미성년자의 신체적, 정신적 건강과 사회의 조화 및 안정에 심 각한 영향을 끼친다. 중국 농촌지역에서의 미성년자 성폭행 방지 및 통제는 경제발전 수준이 도시에 비해 상대적으로 낙후되고, 준법 및 문화수준이 뒤떨어져 있어 정책실 현에 있어 어려움이 있다. 중국정부는 이러한 문제를 인식하고 여러 차례 다방면의 정책을 실시하였지만, 농촌지역의 아동성폭력 방지에 대한 정부가 원하는 국제적 수준 의 효과를 얻지 못하고 있는 실정이다. 이에 본 연구는 중국 농촌지역의 아동성폭력을 방지하기 위해 그 원인을 분석하고, 구체적 문제점과 해결방안을 제시함을 목적으로 한다. 연구를 통해 농촌지역 교사의 아동성폭력 범죄에 대한 130건에 대한 판례를 분석하고, 효과적인 통계 및 요약을 통해 이러한 유형의 범죄가 은폐성이 강함은 물론, 장기적으로 지속되어 저연령인 아동 피 해자에게 심각한 결과를 초래함을 발견하였다. 이에 개인, 가족, 학교, 사회, 법치 차원 에서 범죄의 원인을 심층적으로 분석하여 여러 주체가 참여하는 예방 및 통제 시스템 구축을 개선할 필요가 있다. 또 학교 차원에서도 아동 및 보호자의 성폭력 예방 의식을 전면적으로 제고하고, 학교의 안전감독책임을 수행할 수 있는 방안을 제시하였다.

师源型儿童性侵行为严重影响未成年人的身心健康以及社会的和谐与稳定。相较于 城市，中国农村地区在未成年人性侵犯的预防与控制方面相对滞后，法律意识和文化水 平普遍较低，这为政策的有效落实带来了挑战。中国政府已对此问题予以重视，并采取 了一系列全面的政策调整措施。 本研究旨在深入分析中国农村地区师源型儿童性侵的成因，并结合具体的问题提出 解决方案。通过对130例农村教师涉及儿童性侵犯罪的案例进行系统分析，发现此类犯 罪具有高度隐蔽性和长期持续性的特点，对低龄受害者造成严重后果和深远影响。因 此，有必要从个人、家庭、学校、社会及法律等多个维度全面探讨其成因，并构建多主 体参与的预防与控制体系，以提升其有效性。基于中国当前的治理实践和挑战，尤其提 出应以农村学校为主阵地，全面增强儿童及监护人对性虐待预防的认识，落实校园监管 安全责任以建设安全校园，以及加强未成年人救助与监护制度，并加强司法保护。

Teacher-perpetrated CSA poses a significant threat to the physical and mental well-being of minors, as well as undermining societal harmony and stability. In contrast to urban regions, efforts to prevent and control child sexual abuse in rural China are relatively underdeveloped, characterized by low legal awareness and cultural literacy, which pose challenges for the effective implementation of policies. The Chinese government has acknowledged these issues and undertaken comprehensive policy adjustments. This study aims to conduct an in-depth analysis of the factors contributing to teacher-perpetrated child sexual abuse in rural China and to propose targeted solutions for specific issues. Through a systematic examination of 130 judgment documents involving rural teachers accused of child sexual abuse, it was determined that these offenses exhibit characteristics of high concealment and prolonged persistence, resulting in severe impacts on young victims. Consequently, it is imperative to explore the underlying causes from multiple dimensions—including individual, familial, educational, societal, and legal perspectives—and establish a comprehensive, multi-stakeholder prevention and intervention framework to enhance its effectiveness. Drawing on China’s current governance practices and challenges, it is recommended that schools prioritize the enhancement of awareness regarding sexual abuse prevention among children and guardians, ensure the comprehensive implementation of campus safety supervision responsibilities to establish a secure educational environment, and strengthen as well as optimize the system for assisting and safeguarding minors, alongside reinforcing judicial protection.
