Internet technology, cloud computing, etc. With the thought of “Internet +” gradually entering the public’s field of vision, all walks of life are accelerating the integration of the Internet field, after the gradual emergence of online shopping, Internet insurance, as a new way of selling insurance, more and more favoured by the insurance industry in various countries. Especially since the beginning of 2020, the world has been affected by COVID-19, and the Internet has become a basic way for most people to maintain their lives. The offline -traditional business model was forced to stop all, more and more behaviours are relying on the Internet, so the traditional insurance was hit by a large impact, the Internet insurance also should be the trend to get rapid development. Compared with traditional insurance, Internet insurance enhances the convenience and speed of insurance, so that the insured can receive a variety of information at the customer terminal. The development of Internet insurance has added a variety of sales modes to the traditional insurance, it makes insurance companies provide customers with a wider range of insurance services. However, it cannot be ignored that there are still many problems that have not been overcome in the development process of Internet insurance, such as the lack of a complete legal system for Internet insurance, As insurance companies hold a large amount of customer data in the process, serious information asymmetry that prevents the legitimate rights and interests of the insured (i.e., consumers) from being completely protected. And lack an effective dispute resolution mechanism, and the duty to explain is problematic in Internet insurance, all affect the development and progress of Internet insurance in China. This paper analyses the development history of Internet insurance, as well as the advantages and defects of the development of Internet insurance, conducts a specific analysis of the main problems existing in the development of China’s current Internet insurance. And learns from the excellent experience of Internet insurance in other countries. This paper aims at effectively avoiding the legal problems faced by Internet insurance through the following. First, improve the legal system of Internet insurance, second, sound the legal system of protection of Internet insurance consumers’ rights and interests, third, establish the diversified dispute resolution mechanism for Internet insurance, fourth, improve the system of Internet insurance explanation obligation, etc., so that to provide a legal safeguard for the healthy development of China’s Internet insurance.

네트워크 기술, 클라우드 컴퓨팅 및 기타 ‘IOT 플러스’(“互联网+”)의 개념이 점차 대중의 관심에 따라 모든 산업사이의 IOT 통합이 가속화하고 있다. 그 중 인터넷 쇼핑에서 인터넷 보험서비스는 새로운 보험 판매 서비스로 점점 대중에게 더 많은 관심을 받고 있다. 특히 2020년부터 전 세계 코로나영향으로 인터넷은 대부분의 사람들이 삶에 있어 매우 중요한 매개체로 발돋았다. 오프라인에서 행해진 전통적인 비즈니스 모델이 퇴행되고 점차적으로 더 많은 비지니스 모델이 인터넷에 기반하기에 기존 보험서비스 산업 역시 퇴행됨에 동시에 인터넷 보험서비스의 시장은 빠르게 성장하고 있다. 기존 보험에 비해 인터넷 보험은 보험 가입의 편의성과 업무의 신속성을 향상시켜 피 가입자가 고객 사이트에서 다양한 정보를 받을 수 있도록 되어있다. 인터넷 보험의 성장은 기존의 보험산업에 다양한 비지니스 모델을 추가하여 보험서비스 회사가 고객에게 제공하는 보험 서비스를 보다 더 많은 서비스를 제공하고 있다. 그러나 인터넷 보험서비스의 성장과정에서 해결하지 못하는 문제점이 여전히 많다는 점을 간과해서는 안 된다. 예를 들어, 인터넷 보험서비스는 완벽한 법률 시스템이 부족하며, 보험 회사 또한 서비스 과정에서 모든 고객 데이터를 보유하고 있기 때문에 계약자간 심각한 정보 비대칭으로 인해 피보험자(즉, 소비자)의 합법적인 권익을 완전히 보호할 수 없으며, 분쟁 시 효율적인 분쟁 해결 메커니즘의 부재 및 서비스의설명의무 등 문제들은 중국 인터넷 보험의 장기적인 발전에 영향을 준다. 본문은 중국의 인터넷 보험서비스의 성장 과정과 장점, 현 인터넷 보험서비스의 성장에 문제되는 주요 쟁점들을 구체적으로 분석하고, 타 국가의 인터넷 보험의 우수한 사례들을 참고하였으며, 인터넷 보험서비스의 법률 시스템과 소비자 권익 보호법률 시스템들을 개선하였고 인터넷 보험서비스의 다양한 분쟁 해결 메커니즘을 구축하여 인터넷 보험서비스 설명 의무 시스템을 개선하여 인터넷 보험서비스가 직면한 법률 문제를 효과적으로 차단하고 건전한 보험서비스 발전을 위한 법적 보장을 제공하는 것을 목표로 한다.
