부상과 안전사고가 지속적으로 발생하는 프로스포츠산업의 특징을 고려할 때, ｢중대재해처벌법｣의 시행은 기업 의 프로스포츠 구단의 경영에 상당한 영향을 미칠 것으로 예상된다. 그러나 기업이나 선수 등 프로스포츠 산업의 구성원들 을 포함한 어떤 분야에서도 이와 관련된 이해의 노력이 매우 미흡한 실정이다. 이 연구는 2022년 시행된 ｢중대재해처벌법｣ 의 시행이 기업 운영의 프로스포츠 구단의 운영에 미치는 영향에 대하여 기업의 시각에서 법률적으로 접근하고 분석하며, 이에 대한 대처방안을 제안하는 것을 목적으로 한다. 연구방법으로는 문헌고찰 방법이 사용되었으며, 연구의 결과를 요약 한 것은 다음과 같다. 첫째, ｢중대재해처벌법｣은 크게 적용대상, 중대산업재해와 중대시민재해 구성요건, 안전·보건 확 보 의무, 사업주 및 경영책임자에 처벌 등을 주요 내용으로 한다. 둘째, 기업의 프로스포츠 구단 운영 환경을 고려할 때, ｢중대재해처벌법｣은 프로스포츠 구단을 소유한 기업에게도 적용될 수 있다. 셋째, 이 연구에서는 단서 조항의 활용, 안 전·보건 확보의 상시적 이행, 적절한 사후 조치를 대응 방안으로 제시하였다.

Considering the characteristics of the professional sports industry where injuries and safety accidents continuously occur, the enforcement of the ｢The Serious Accidents Punishment｣ is expected to have significant impact on the management of corporate professional sports clubs. However, including the professional sports industry, such as companies and players even the teams, efforts to understand this are very insufficient. The purpose of this study is to legally approach and analyze the impact of the enforcement of ｢The Serious Accidents Punishment｣ in 2022 on the operation of professional sports clubs from the corporate perspective, and to propose countermeasures for this. are leaving A literature review method was used as a research method, and the summary of the results of the study is as follows. First, the major contents of the ｢The Serious Accidents Punishment｣ include the subject of application, the components of serious industrial accidents and major civil accidents, the obligation to secure safety and health, and punishment for business owners and management managers. Second, considering the operating environment of corporate professional sports clubs, the ｢Severe Accident Punishment Act｣ can also be applied to companies that own professional sports clubs. Third, in this study, the use of provisions, regular implementation of securing safety and health, and appropriate follow-up measures were suggested as countermeasures.
