이 논문은 2020년 개정된 중국의 ｢미성년자 보호법｣과 ｢예방미성년자범죄법｣의 주요 개정내 용을 소개하여 최근 중국의 소년법제 관련 동향을 파악하고, 한국의 소년법에의 시사점을 검토 하는 것을 내용으로 한다. 중국의 ｢미성년자 보호법｣은 가정, 학교, 사회 및 국가가 전방위적으 로 미성년자를 보호할 의무와 책임을 부담하는 내용의 법률로서 미성년자의 보호를 주된 목적으 로 하는 법률이다. 반면, ｢예방미성년자범죄법｣은 범죄를 범한 미성년자 또는 심한 불량행위를 행한 미성년자를 교정교화하기 위한 조치들을 담고 있는 법률로서 한국 소년법의 보호처분적 성격을 일부 가지고 있는 법률이다. 한국과 중국은 헌법이나 정치체제가 다르고, ｢소년법｣이라는 단행 법률을 두고 있는지 여부 에도 차이가 있다. 그러나 소년은 보호의 대상임과 동시에 소년이 범죄를 범한 경우 형사제재의 대상이 된다는 점은 양국에서 차이가 없다. 최근 중국의 소년법제 관련 주요 법률의 개정 내용을 살펴보는 것은 중국에서 미성년자를 보호하는 한편 소년범죄에 대한 대책을 어떠한 관점에서 구상하고 있는가를 가늠해 볼 수 있도록 해 줄 것이다.

This paper introduces the major revisions of China's Juvenile related legislation, “Juvenile Protection Act” and “Preventive Juvenile Crimes Act” revised in 2020 to understand the recent trends in China's juvenile law system, and to review the implications for Korea's juvenile law system. China's “Juvenile Protection Act” is a law whose main purpose is to protect minors. Families, schools, society and the state bear the obligations and responsibilities of protecting minors in all directions. On the other hand, the ｢Preventive Juvenile Crimes Act｣ is a law that contains measures to correct and rectify minors who commit crimes or minors who commit serious bad behavior, and has some of the protective dispositions. Korea and China have different constitutions and political systems, and there is also a difference in whether they have a single law called the “Juvenile Law”. However, there is no difference between the two countries in that juveniles are subject to protection and at the same time subject to criminal sanctions when a juvenile commits a crime. Examining the recent revisions in China's major laws related to the juvenile law system will will also give implications for Korea.
