근대사회 이전에 의사는 의사와 환자 관계의 주체로 여겨져 주도적인 지위를 차지했다. 사람들은 흔히 의사의 권리를 강조하고 환자의 권리를 자발적 권리로 존재하는 것일 뿐이라고 여겼다. 18세기에 이르러서야 환자의 권리는 사회 대 중과 환자 본인의 관심을 불러일으키고 자각적인 권리가 되었다. 그러나 ‘환자’ 가 의료행위의 출발점이고, ‘환자의 권리’는 의료법률관계의 기본개념이다. 신중국이 건국된 후 70여 년 동안 중국의 위생사업은 계속 발전하고 위생과 관련한 입법도 점차적으로 정비되었다. 그러나 ‘환자’의 개념은 중국의 위생 입 법에서 명확하게 정의되지 않고 있다. 중국의 위생 입법에서 ‘환자(患者)’와 ‘병 자(病人)’라는 두 개념이 오랫동안 혼용하여 사용되어 왔다. 2019년 3월 ‘의료 기관 민원 관리방법’(국가위생건강위령 제3호)이 처음으로 환자의 개념을 정의 했지만, 매우 부정확하다. 또 중국은 환자의 권리에 관한 전문 입법이 없고 환 자권리의 규정은 여러 입법에 분산되어 있으며, 환자 권리의 함의가 불확실하 다. 환자의 권리에 대하여 위생관련 법률이 서로 다르게 정의하고 있는 경우도 있으며, 심지어는 그 개념이 서로 충돌하기도 하여 법적 보호가 어렵게 되는 경 우도 있다. 이는 환자의 권리 보장과 구제에 매우 불리하게 작용한다. 만약 의 료분쟁이 발생할 때 의사와 환자의 의견차이가 발생하게 되어 분쟁해결에도 어 려움을 준다. 본 연구에서는 중국의 보건 및 의료 관련 입법의 발전과정을 정리하고 분석 하였다. 이들 위생 입법 중 145건에 대하여 환자의 권리에 대한 입법의 변천과 정을 분석하여, 환자의 권리에 관한 규정의 문제점을 검토하였다. 또 환자의 권 리를 일반환자와 특수환자, 그리고 법률, 행정법규, 부문규정으로 나누어 분석하였다.

Before modern society, doctors were regarded as the main body of doctor-patient relationship and occupied a dominant position. People often highlighted the rights of doctors, and the rights of patients existed as a spontaneous right. It was not until the 18th century that the rights of patients attracted the attention of the public and patients themselves, and became a self-conscious right. However, “patient” is the starting point of medical behavior, and “Patients' rights” is the basic concept of medical legal relationship. Over the past 70 years since the founding of new China, China's health undertakings have developed continuously and health legislation has been gradually improved. However, the concept of “patient” has not been clearly defined in China's health legislation. In China's health legislation, the two concepts of “patient” and “sick” have been mixed for a long time. In March 2019, the measures for the management of complaints from medical institutions (Order No. 3 of the National Health Commission) defined the concept of patients for the first time, but it was very inaccurate. At the same time, there is no special legislation on Patients' rights in China, and the provisions on Patients' rights are scattered in many legislations. There are some problems, such as uncertain connotation of Patients' rights, inconsistent expression of the same right in health legislation, even conflict with each other, inadequate protection and so on, which are very unfavorable to the protection and relief of Patients' rights, and exacerbate the differences between doctors and patients to a certain extent, it is not conducive to the resolution of medical disputes. By combing the development history of China's health legislation, the author makes full caliber statistics on 145 currently effective health legislation in China, comprehensively analyzes the changes of Patients' rights legislation in the four stages of China's health legislation, analyzes the problems existing in China's Patients' rights legislation, and makes suggestions on improving China's Patients' rights from ordinary patients and special patients, as well as laws, administrative regulations The two legislative levels of departmental rules put forward the idea of perfection.

近代社会以前，医生被视为医患关系的主体，占据主导地位，人们往往突出强调 的是医生的权利，对于患者权利作为一种自发性权利而存在。直至18世纪，患者权 利才引起社会公众以及患者本人的关注，成为一种自觉自为的权利。然而，“患者” 才是医疗行为的起点，“患者权利”则是医事法律关系的基本概念。 新中国建国70余年来，中国卫生事业不断发展，卫生立法也逐步完善。但是“患 者”的概念却一直未在中国卫生立法中明确界定,中国的卫生立法中“患者”与“病人”两 个概念长期混用。2019年3月，《医疗机构投诉管理办法》（国家卫生健康委令第3 号）首次对患者概念进行界定，却非常不准确。与此同时，中国没有关于患者权利 的专门立法，患者权利的规定散见于多个立法当中，存在患者权利的内涵不确定、 同一权利在卫生立法中表述不一致甚至彼此冲突、保护不充分等问题，对于这对患 者权利的保障与救济都十分不利，也在一定程度上加剧了医患分歧，不利于医疗纠 纷的化解。 笔者通过梳理中国卫生立法的发展历史，对中国现行有效的145件卫生立法进行了 全口径统计，全面分析了中国卫生立法的四个阶段中患者权利立法的变化，剖析了 中国患者权利立法中存在的问题，对完善中国患者权利从普通患者及特殊患者，以 及法律、行政法规、部门规章二个立法层级提出了完善的设想。
