국제사회는 국제분쟁과 충돌로 평화적 해결을 부르짖는 기조 아래 일방적 경제제재 가 빈번하게 사용되고 있다. 미국은 20세기 이래 전 세계에서 경제제재 수단을 가장 많이 사용한 나라로 주로 개발도상국이 제재 대상이다. 일방적 경제제재는 일방주의에 관한 것으로 유엔헌장의 취지와 기본원칙에 위배된다. 타국에 대한 일방적 경제제재는 다른 나라의 주권을 침해하는 것은 물론, 제재 목표국과 제3국 국민의 기본적 인권 향유에도 악영향을 미치고 국제인권헌장의 인권원칙에도 위배된다. 이로 인해 역외 경제제재에 대한 국제사회의 ‘입법거부’가 잇따르고 있지만, 그 성과는 여전히 미미하 다. 이에 따라 유엔총회, 인권이사회, 경제사회이사회 등 인권보장기구들은 ‘일방적 강 제조치와 인권’이라는 의제를 놓고 일방적 경제제재를 조약·결의로 규제하면서 일방적 경제제재가 인권에 미치는 부정적 영향을 규탄하였다. 또 모든 국가가 국제법·국제인 권법·유엔헌장 기본원칙에 부합하지 않는 어떤 일방적 제재를 중단하거나 집행할 것을 촉구했다. 본 연구에서는 일방적 경제제재가 인권에 미치는 부정적 영향을 검토하였다. 또 유 엔 규제의 일방적 경제제재를 전면적으로 분석하였다. 이를 통해 각국이 다른 나라로 부터의 일방적 경제제재에 대응하는데 참고가 될 것이다. 즉, 각국은 앞으로 관련 제재 규정의 제정 및 시행에서 국제인권헌장에 따른 인권 의무를 적극적으로 이행하고, 충 분한 인권 존중과 보호를 목표로 제재 정책의 타당성을 심사해야 한다. 각국은 다른 나라로부터의 일방적 경제제재에 대응함에 있어 기존 유엔 규제의 일방적 경제제재 적용을 규탄하고 저지하는 메커니즘을 충분히 활용해야 한다. 한편, 한국과 중국은 UN회원국으로서 국제인권보장사업의 적극적 참여자이면서 한 때는 일방적 경제제재의 피해자로서 일방적 경제제재에 대한 유엔의 규제를 이해하고 지지하고 있다. 그러므로 한국과 중국은 유엔 다자체제에서의 중요한 역할을 인식하고, 국제사회에서 적극적 대화를 통해 일방적 경제제재에서 최소한의 인권보호에 대한 국 제사회의 공감대를 형성하여야 할 뿐만 아니라, 국제분쟁의 평화적 해결을 촉진하는 데 공헌하여야 할 것이다.

在提倡和平解决国际争端与冲突的主旋律下，单边经济制裁被频繁使用。美国是20 世纪以来全世界使用单边经济制裁最多的国家，制裁对象主要为发展中国家。单边经济 制裁涉及单边主义，违背了《联合国宪章》的宗旨和基本原则。域外实施单边经济制 裁，不仅侵犯了其他国家主权，还给制裁目标国甚至第三方国家人民的基本人权享有造 成了负面影响，违反了《国际人权宪章》的人权原则。国际社会纷纷颁布 “阻却立法” 来对抗域外实施单边经济制裁，但却成效甚微。有鉴于此，联合国大会、人权理事会、 经济与社会理事会等人权保障机构围绕 “单方面强制性措施与人权” 议题，通过条约、 决议对单边经济制裁加以规制，谴责单边经济制裁对人权享有造成的负面影响，呼吁所 有国家停止采取或执行不符合国际法、国际人权法、《联合国宪章》基本原则的任何单 边制裁。 研究单边经济制裁对人权造成的负面影响，全面了解联合国规制单边经济制裁的措 施，将为各国应对来自他国的单边经济制裁提供有意参考。各国未来在相关制裁规则的 制定和实施中，应积极履行根据《国际人权宪章》所承担的人权义务，以充分尊重和保 护人权为目标，审查制裁政策的可行性。在应对来自他国的单边经济制裁时，各国应充 分运用联合国现有的规制单边经济制裁的机制，谴责和抵制单边经济制裁的使用。 中韩两国一直是国际人权保障事业的积极参与者，同作为联合国会员国，了解和支 持联合国对单边经济制裁的规制，主张在联合国多边机制下积极对话，将有助于推动国 际社会就单边经济制裁中的最低人权保护达成共识，有利于促进和平解决国际争端。

Unilateral economic sanctions are frequently used in the name of promoting peaceful settlement of international disputes and conflicts. Since the 20th century, the United States has become the country which has applied the most unilateral economic sanctions in the world, with developing countries as the main targets of its sanctions. Unilateral economic sanctions involve unilateralism and violate the purposes and basic principles of the Charter of the United Nations. The extraterritorial application of unilateral economic sanctions not only infringes the sovereignty of other countries, but also has a negative impact on the enjoyment of basic human rights of the people of the target states and even third-party states, which violates the human rights principles of the International Bill of Human Rights. The international community has enacted “blocking statutes” to resist the extraterritorial application of unilateral economic sanctions, to little effect. In response, on the issue of “unilateral coercive measures and human rights”, the General Assembly of the United Nations, the Human Rights Council, the Economic and Social Council and other human rights protection bodies, regulate unilateral economic sanctions through treaties and resolutions, condemn the negative impact of unilateral economic sanctions on the enjoyment of human rights, and call on all countries to stop adopting or implementing unilateral sanctions that are not in line with international law, international human rights law and the basic principles of the Charter of the United Nations. The study of the negative impact of unilateral economic sanctions on human rights and fully understanding the measures of the United Nations to regulate unilateral economic sanctions will provide meaningful reference for countries dealing with unilateral economic sanctions. In future formulation and implementation of relevant sanctions rules, all countries should actively fulfill their human rights obligations under the International Bill of human rights, and review the feasibility of sanctions policies with the goal of fully respecting and protecting human rights. When dealing with unilateral economic sanctions from other countries, all countries should make full use of the existing mechanism of the United Nations to condemn and resist the use of unilateral economic sanctions. China and South Korea have always been actively involved in international human rights protection. As both the member states of the United Nations, understanding and supporting the regulations on unilateral economic sanctions adopted by the United Nations and advocating active dialogue under the multilateral mechanism of the United Nations will help engage the international community in reaching a consensus on the minimum human rights protection in unilateral economic sanctions and promote the peaceful settlement of international disputes.
