일반적으로 동물은 도덕적인 권리를 갖는 반면 법적인 권리를 갖지 못한다. 다만 동물보호법 에서는 동물의 권리와는 별도로 인간에게 반려동물을 보호하도록 규정하고 있지만 헌법에서는 간접적으로 환경권과 자연보호 규정에서 보호하고 있기 때문에 직접적으로 반려동물을 보호하 는 방안을 모색할 필요가 있다. 왜냐하면 헌법상 효력은 법률에 비하여 상위의 효력이 존재하기 때문이다. 이러한 취지에 부합하는 방안으로써 공리주의 관점에서 본다면 그 동물의 소유권자의 기본권 즉, 동물소유권자의 ‘인간존엄과 행복추구권’이 결부된 기본권에서 그 근거를 도출할 필 요가 있다. 한편 동물보호법상 인간과 동물의 반려관계는 3단계(성립⋅유지⋅종료단계)로 구분 할 수 있고, 각 단계별로 반려동물의 복지를 강화하는 방향으로 나아가고 있다. 하지만 이러한 단계도 ‘COVID-19사태’ 등의 특수한 상황 등과 ‘제4차 산업혁명’을 맞이하는 상황 속에서 이에 부합하는 ‘인간과 동물의 반려관계’를 새롭게 정립할 필요가 있다.

Generally, animals have moral rights, but don’t have legal rights. Aside from the rights of animals, the law on animal protection stipulates the human’s obligation of companion animal protection. But, Constitution protects animals by the stipulations related to environmental rights and nature protection stipulation. So, it is necessary to find the way to protect animals directly. It is because the effectiveness of Constitution is higher than that of law. As a way correspondent to the purpose in view of practical viewpoints, it is necessary to draw the basis from animal owner's basic rights, that is the basic rights related to ‘human dignity and the right to pursue happiness’ of animal owners. On the basis of this, in view of the law on animal protection, the companion relationship between humans and animals is classified with three stages (formation, maintain, and end). Respective stage tends to enhance the welfare of companion animals. But, in the peculiar conditions such as ‘COVID-19 crisis’ and ‘the fourth industrial evolution’, it is necessary to newly establish ‘companion relationship between humans and animals corresponding to this’.
