현재와 미래의 지능정보산업은 개인정보데이터를 원천자산으로 하는 빅데이터, 사물인터넷, 인공지능 산업에 전적으로 의존할 것이다. 그러나 현재는 거대 데이터 플랫폼 기업들이 데이터 시장에서 개인정보 보유자를 압도하는 우월적 지위를 가지고 있기 때문에 원 데이터 제공자는 데이터 플랫폼 기업의 시장지배적 지위로 인해 어쩔 수 없이 다시 자신의 개인 정보를 해당 플랫폼에 제공하며 서비스를 이용할 수밖에 없는 것이 현실이다. 지능정보기술의 비약적 발전에 발맞추어 현행법에서 데이터를 사법상 물건(또는 형법상 재물)으로 해석하거나 규정한다면 실 타래 같이 얽혀 있는 많은 법률적 문제들을 해결할 수 있을 것이다. 또한 개인정보 데이터에 대해 배타적 지배력이 인정되는 개인의 소유권도 보장받을 수 있어 거대 플랫폼 기업과의 데이 터거래에서도 정당하면서도 공정한 이익을 공유할 수 있을 것이다.

The present and future intelligent information industry will depend entirely on the big data, IoT, and artificial intelligence industries that take personal information data as a source asset. However, because large data platform companies currently have a superior position in the data market that overwhelms the holders of personal information, the original data provider is forced to provide their personal information back to the platform due to the market dominance of the data platform companies. The reality is that you have no choice but to use the service. In line with the rapid development of intelligent information technology, if the current law interprets or defines data as property on civil law(or property on criminal law ), many legal problems such as skeins can be solved. In addition, ownership of individuals whose exclusive control over personal information data is recognized can be guaranteed, so that fair and fair profits can be shared in data transactions with large platform companies.
