본 연구는 정당 간 합의에 의해 본회의에 상정되었지만 반대와 기권표의 비중이 크게 나 타난 상가건물 임대차보호법과 조세특례제한법 개정안에 대한 의원들의 투표행태를 분석 하였다. 기존 연구들에서는 주로 정당, 이념, 지역구 이익 등 크게 세 가지 차원에서 의원 들의 투표행태를 설명해왔지만, 본 연구에서는 의원의 자율성이라는 변수에 주목하여 ‘당 론이탈투표율’을 모형에 포함시켜 분석하였다. 분석 결과, 20대 국회 전반기에 당론이탈투 표율이 높은 의원일수록 두 법안 모두에 반대 혹은 기권할 가능성이 높게 나타났다. 둘째, 상가 공실률이 높은 지역구의 의원일수록 두 법안 모두에 찬성할 가능성이 높게 나타났다. 본 연구는 투표행태 분석에서 의원들의 자율성이 중요한 변수로 작용하고 있다는 점을 발 견했다는 점에서 의의가 있다. 향후 입법과정과 투표행태 연구 분야에서 의원의 자율성에 대한 논의와 경험적 분석들이 지속적으로 이루어져야 할 필요성이 제기된다.

The purpose of this study is to analyze the voting behaviors of legislators on the amendment of Commercial Building Lease Protection Act and Special Taxation Restriction Act. Although previous studies have mainly explained the voting behavior of legislators on three major dimensions, including party, ideology, and constituency interest, this study included the 'party defection voting rate' in the model, paying attention to the variables of legislator’s autonomy. As a result of the analysis, the higher the party defection voting rate in the first half of the 20th National Assembly, the higher the likelihood of opposing or abstaining from both bills. Second, the legislators with the high vacancy rate in commercial buildings are more likely to agree with both bills. This study is significant in that it found that the party defection voting rate is an important variable in the voting behavior of legislators.
