미성년자에 대한 후견 입법체계는 민법전에서 체계적인 구조를 갖추어야 한 다. “가족후견을 기초로, 사회후견을 보충으로, 국가후견을 기반으로”하는 원칙 규정에 근거하여 중국민법총칙은 제2장 “자연인” 제2절 “후견”에서 미성년후견 과 관련한 총칙적인 규정을 두고 있다. 향후 제정될 혼인가족편에서는 우선, “부모와 자”파트에서는 “미성년자녀에 대한 부모책임”을 규정하여 부모와 자녀 사이의 권리·의무관계를 명확히 하여야 하고, 부모는 자녀의 가장 중요한 책임 자임을 명시하여야 한다; 다음으로, 가족편에서는 “미성년후견”을 독립적으로 규정하여 미성년자에 대한 후견제도를 총정비하고 구체화함으로써 결국에는 미성년자에 대한 “부모·가정·사회·국가”일체가 협력하는 후견체계를 구축하여 야 한다.“부모·가정·사회·국가”일체가 협력하는 후견체계 구축을 위하여 우선 미성년자녀는 부모로부터 양육과 사랑, 교육, 보호를 받도록 하여야 한다. 부 모는 미성년자녀 보호의 최일선에 서는 자이다. 부모의 미성년자녀에 대한 보 호에 문제가 발생하였을 경우, 기타 친족 및 후견의사·후견능력이 있는 개인이 나 사회단체는 미성년 보호의 그 다음 주자가 되어야 한다. 다만 이들은 후견 규정에 근거하여 성실히 보호의무를 이행하여야 하고, 후견감독인·후견감독조 직의 감독을 받아야 한다. 만약 이 과정에서 다시 문제가 발생하여 이들이 후 견의무를 이행할 수 없을 경우, 관련되는 기초행정단체는 미성년 보호의 그 다 음 주자로서 임시적으로 후견의무를 이행하여야 한다. 미성년자 보호의 최종 수호자는 사법기관(법원)과 상위행정기관이어야 한다. 관련 부서는 이들을 대 표하여 부모와 가정을 도와 후견책임을 맡고, 각종 후견감독을 함으로써, 최후 의 보루로 미성년자의 건강한 성장, 즐거운 생활을 보장하고 자녀복리최우선원 칙을 진정으로 실현하여야 한다.

The improvement of the legislation system of juveniles’ guardianship embodies the harmony and unity of the logical system and the value system of the Civil Code, so that the Civil Code can form the organic combination, the orderly complementary and coordinated juveniles protection system. The General Principles of Civil Law of the People' s Republic of China stipulates clearly the basic framework and main contents of the guardianship system. The principle of the best interests of children and the principle of the autonomy of children are regarded as the basic principles of guardianship of juveniles and are embodied in the specific provisions of the guardianship system for juveniles which have enriched the system of guardianship of juveniles in China. The marriage and family legislation should adhere to the principle of the best interests of children, list parent-child relationship chapter and guardianship chapter separately, define “parental responsibility”. In the chapter of parent-child relationship, the rights and obligations between parents and children should be better clarified and the role of parents as the primary responsibility of the juveniles should be highlighted. The guardianship chapter should focus on improving and refining the guardianship system; clearly stipulate the supervision system; strengthen the national guardianship responsibility in order to give the maximum priority to protect the juveniles' rights.

民法典未成年人监护立法体系应当形成有机结合、有序互补、协调一致的体系化格局. 未成年人监护体系应当以保护未成年人的权益为目标,以儿童人权理念为指导,将子女最佳利益原则作为确立未成年人监护体系及父母责任、监护制度的基本原则. 依据民法总则确立的“以家庭监护为基础,社会监护为补充,国家监护为兜底”的原则性规定,编纂婚姻家庭编时,一方面,要在亲子关系章中强化父母责任,明确父母作为子女的首要责任人地位,明晰父母对子女的具体权利义务关系,全面保护未成年子女利益；另一方面,要在婚姻家庭编中专门设立监护一章，进一步完善与细化监护制度,最终形成父母、家庭、社会、国家四位一体全方位对未成年人的保护机制和监护体系. 父母是未成年人保护的第一环,未成年子女在家庭中应当得到父母尽职尽责的抚养、关爱、教育和保护. 在第一环出现问题时,其他亲属及有意愿、有能力的个人或社会组织是未成年人保护的第二环,他们必须按照有关监护的规定认真履行监护职责,接受监护监督人及相关组织的监督,确保未成年被监护人利益的实现. 在第二环出现问题时，相关的社会团体及基层群众性组织是未成年人保护的第三环,通过直接担任临时监护人、提供辅导帮助或担任监护监督人等方式承担社会监护职责. 最后一个保护环是国家监护. 国家有关部门应当代表国家通过协助父母、帮助家庭、担任监护人、履行监护监督职责等各种方式,完成“国家兜底”的未成年人守护者的国家责任,确保未成年人健康成长、快乐生活,真正实现未成年人利益最大化.
