몽골은 1990년대 초반 공산주의에서 민주주의 국가체제로 전환된 이래로 급격히 도시화되어 현재 많은 사람들이 울란바타르를 중심으로 살고 있는데 경제적 어려움, 직업의 부족, 극한 겨울, 부족한 보건 및 건강서비스, 장애 등을 원인으로 어려움을 겪고 있다. 특히 몽골 인구의 많은 수를 차지하고 있는 아동들은 빈곤 속에서 가정폭력에 노출되어 학대를 당하고 있고 노동력을 착취당하는 등 부정적인 영향을 받고 있다. 몽골의 다양한 비정부기관들은 취약 아동들의 보호를 위하여 노력하고 있지만 이들에게 놓여 있는 가난, 차별, 억압, 학대 등에 대처하기에는 여전히 많은 한계가 있다. 이러한 상황 속에 몽골 울란바타르에서는 2018년 3월 발생한 아동강간사건을 계기로 아동학대의 가해자에 대한 엄중한 처벌을 요구하는 시위가 일어나기도 하였는데, 해당 시위는 몽골에서 발생되고 있는 아동학대의 심각성을 국내외적으로 드러내는 계기로 작용하였다. 이에 본 논문은 몽골 아동의 권리보호를 위한 법적·제도적 체계를 갖추는데 필요한 내용들을 제언하는 데에 중점을 두면서, 기존 몽골의 법체계는 물론 아동을 바라보는 사회구조적 인식을 살펴보는 한편 아동학대를 포함한 몽골 아동의 취약 원인을 분석함으로써 앞으로 몽골에서 아동권리 보호를 위하여 논의되어야 할 내용들에 대하여 다루고 있다.

Since the transition from a communist to a democratic nation in the early 1990s, Mongolia has rapidly been urbanized. By now, many people live in Ulaanbaatar or near the city. Many people suffer from difficult living conditions, lack of jobs, extreme winter weather conditions, insufficient health services, etc. In particular, children who represent a large proportion of the population in Mongolia are exposed to domestic violence, poverty, the exploitation of the labor force and the prospect of a bleak future. Although various non-governmental organizations in Mongolia have tried to protect vulnerable children, their possibilities of coping with deprivation, discrimination, abuse, and fatal circumstances are limited. Under these circumstances, there was a massive demonstration against child abuse in Ulaanbaatar on March 31, 2018. The outrage resulting from cases of severe child abuse in Mongolia had caused people to gather in front of the Parliament and demand severe punishment for child abusers. This paper examines the legal grounds for the protection of children's rights and the social awareness on children's rights in Mongolia. While this paper reviews specific examples and legal issues contributing to the vulnerability of Mongolian children, it also deals with possibilities of enhancing the protection of vulnerable children in Mongolia.
