인공지능 기술을 둘러싼 법규범 담론이 증가하고 있다. 물론 아직까지 국내외적으로 명확한 입법대안이 추진되고 있는 것은 아니다. 다만 인공지능 기술의 영향을 추적하는 가운데 입법적 대응이 필요한 위험요인들을 분석하고 있는 과정이다. 현재의 인공지능 기술은 이제까지 발전해 온 네트워크 중심의 IT기술 발전에 터 잡고 있다. 빅데이터(Big Data), 클라우드 컴퓨팅(Cloud Computing), 사물인터넷(Internet of Things) 등의 용어는 이러한 기술적 저변을 나타내준다. 따라 서 인공지능 기술 발전에 대비한 법적 대응방안을 모색하는 데 있어서는 이제까지의 IT법체계 정비에 관한 논의를 필수적으로 수행해야 한다. 그런데 국내 IT법체계는 매우 복잡한 지형을 가지고 있어 다양한 문제점들을 드러내고 있다. 이러한 관점에서 이 논문은 IT법체계 개선 방향 을 모색하는 데 초점을 둔다. 최근 인공지능은 정보(데이터)의 학습을 통해 스스로 알고리즘을 구성 및 수정해 나가는 특징 을 보여주고 있다. 정보와 알고리즘(algorithm)은 인공지능의 판단결과를 실질적으로 지배하고, 그 결과는 인간의 행위를 제약하는 요인으로 등장하고 있다. 따라서 인공지능에 관한 법적 대응 방안 모색은 그것의 기술적 근간이라고 할 수 있는 정보와 및 알고리즘의 질적 속성에 관한 이해로부터 출발할 필요가 있다. 이에 이 논문은 과거 법정보학(legal informatics) 연구의 변화가 필요하다는 점을 주장하고, 이에 터 잡아 현행 IT법체계 개선의 방향성을 제언한다.

Discussions on legal norms surrounding artificial intelligence technologies are increasing. Of course, there is not yet a clear legislative alternatives in Korea and abroad. However, it is the process of analyzing the risk factors that require legislative response while tracking the impact of artificial intelligence technologies. The current artificial intelligence technologies are based on the development of the network-centric IT technologies those have been developed so far. The terms such as Big Data, Cloud Computing, Internet of Things represent this kind of technological baseline. Therefore, in order to find legal alternatives on the development of artificial intelligence technology, it is necessary to carry out discussions about the improvement of the current IT legal system. The Korean IT legal system, however, has a complicated terrain and reveals various problems. In this respect, this article focuses on finding ways to improve the IT legal system. Recently, artificial intelligence shows the characteristic of organizing and modifying algorithms by learning data(information). Information and algorithms substantially dominate the judgment result of artificial intelligence, and the result is emerging as a factor restricting human behavior. Therefore, it is necessary to start from the understanding of the qualitative properties of the information and algorithms that can be called the technical basis of the artificial intelligence. In conclusion, this article argues that the change of legal informatics research as in the past is needed and, applying the context, suggests the direction of improvement of current IT legal system.
