근래 한국과 몽골 양국은 대외적으로 서로 다양한 교류를 하고 있으면서도 법률적인 면에서는 아직 미흡한 편이다. 형법 뿐만 아니라 몽골법 전체를 보더라도 소개하고 있는 국내의 문헌도 상당히 드물다. 있어도 개괄적이거나 단편적인 영역에 한정되어 있는 상황이다. 따라서, 본 논문에서는 몽골 형법의 소개와 함께 뇌물범죄와 부정부패 방지를 위한 노력 중 하나로써 몽골 형법상 뇌물죄를 종합적으로 고찰함과 동시에 한국과는 어떻게 다른지 비교함으로써 몽골 형법이 나아가야 할 방향을 제시하고자 하였다. 보호법익에서부터 시작하여 뇌물죄의 주체, 객체(뇌물), 대가성, 직무관련성 등 일반적인 요건들 뿐만 아니라, 뇌물수수, 뇌물공여, 뇌물중재 등 세 가지 유형별로 나누어 몽골 형법이론을 소개하고 한국의 형법과 비교 고찰하였다. 더불어, 몽골은 2015년 대대적인 형법개정으로 2017년 7월 새로운 형법이 시행되었는데, 뇌물죄에 있어서 구법과 신법이 어떠한 차이가 있는지도 고찰하였다.

Recently, both Korea and Mongolia have been engaged in various cultural exchanges with each other, However, legal exchanges are not much. It is also rare in the criminal law area and the Korean literature which introduces the entire Mongolian law is quite rare. Even if it exists, it is limited to a very general or fragmented area. Therefore, in this paper, while introducing the Mongolian Criminal Law, as a first effort to prevent bribery and corruption, I will review the bribery crime in Criminal law in Mongolia in a comprehensive manner and compare how it differs from Korea, and I suggested how Mongolian criminal law should be changed. Starting with the benefit and protection of the law of bribery by introducing into the theory Mongolian Criminal law, as well as the general requirements, including actors of bribery, objects(bribe), Bribes in exchange for actions, bribe related to the job, and I classified Mongolian criminal law into three types accepting bribes, giving bribes and Brokage a bribe and compared it with Korean criminal law. In addition, in Mongolia, a new criminal law was enacted in July 2017 due to the amendment of the large-scale criminal law in 2015, and the difference between the old law and the new law in bribery was examined.
