이 논문은 상속포기의 효력이 대습상속에까지 미치는지 여부에 관한 대상판결의 정당성 여부를 검토한 것이다. 상속포기의 목적과 대습상속의 목적이 서로 다른 경우에는 논의의 여지가크지 않겠지만, 그 목적이 동일한 경우 구체적 타당성에 부합하는 결론인지에 대한 검토가 필요하다. 상속자의 자유로운 의사표시에 기한 일정한 방식과 절차에 따라 행해진 상속포기의 효과는그 대상인 본위상속에만 미칠 뿐, 다른 제도인 대습상속에까지 미치지 않음은 민법의 해석상지극히 당연하다는 점에서 대상판결의 결론은 정당하다. 대상판결은 상속의 목적물의 동일성 여부와 관계없이, 본위상속을 포기한 자도 그 고려기간내에 대습상속에 대한 한정승인 또는 그 포기를 하지 않은 이상 제1026조 제2호 소정의 법정단순승인을 한 것으로 의제될 뿐이라는 점을 분명히 밝혀주고 있다. 대상판결은 ‘어느 누구도 주어진 권리를 행사하지 않고, 그 권리의 귀속을 기대할 수는 없다’는 점을 확인시켜 준 의의가 있다.

This paper has reviewed the validity of the judgment on whether the Renunciation of Inheritance affects Inheritance by Representation. It would be non-debatable if the purpose of both were different, but it is necessary to examine those cases if the purpose of both is the same. The conclusion of the judgment is justifiable based on the theory that, the effect of the Renunciation of Inheritance through the provided means and procedure is based upon the free expression of the inheritor, influences only the Standard Inheritance, not the Inheritance by Representation. It is clear that the court judged that whether or not the objects of inheritance are same, an inheritor who refuses a standard inheritance shall be deemed to have absolute acceptance by article 1026(2), unless the inheritor has agreed to either a Qualified Acceptance of Inheritance of the Inheritance by Representation or a Renunciation of the Inheritance by Representation within a reasonable period. The judgment confirmed the fact that no one can expect their rights without exercising them.
