在中国的刑事诉讼立法之中，争议中的或者疑似的“非法证据”能否成为定案根据可谓是要经过层层关口：单就审判程序而言，就有层层设卡的六道关口（立法设定-庭前准备争点整理-庭审职权调查-控方客观真实义务-辩方对抗-二审全面审查）， )同样，检察机关对刑事诉讼的多点参与（自行侦查、审查逮捕、审查起诉和出庭支持公诉）及其扮演的多维角色，从而也使其承担了对非法取证活动进行发现、启动、调查核实、审查、判断以及对非法证据决定排除或者在庭审之中举证、辩论的职能。虽然，通过技术性细节合理规制指令权、职务转移以及官员代换制的适用以寻求检察事务中的检察官独立行使职权和检察一体之间的平衡， )但是基于检察机关行使法律监督职责作为整体而参与各诉讼环节以及各诉讼活动之间的前后衔接，因此，检察机关对非法证据排除活动也存在着内设部门之间或者内外机关之间的信息互通和决策互动的机制。规则只有通过程序才最终落到实处，尽管程序自身也可能是正式规则或者非正式规则。由于非法证据排除之所谓“非法”既牵涉到对公权力行使的限制，又牵涉到基本人权的保障，因此保障非法证据排除规则的程序性规则也是至关重要的，由此，非法证据排除的实体规则和程序规则相配套是一个必然之举，然而，《刑事诉讼法》对于检察机关排除非法证据却只有实体性要求却无相应的程序性规则，这个立法漏洞为2012年最高人民检察院制定的《人民检察院刑事诉讼规则（试行）》（以下简称《高检规则》）进行了一定程度的弥补。作为中国独具特色的制度，司法实践中，检察机关调查核实非法取证行为存在着面临线索发现难、调查取证难、核实认定难的问题。 )本文结合人民检察院的司法实践，细致梳理《高检规则》相关规定，试图厘清检察机关非法证据排除规则的程序运行机制。概而言之，非法证据排除的运行机制包含了内部的行政事务处理与司法听审程序之间互动。如果只是把视野局限于一种所谓自由证明或者严格证明的外部程序则完全忽略了内部办案机制及其可能对非法证据排除的具体实施带来的影响。

Exclusion of illegal evidence by the procuratorial organs must be seamless to link with procedural stages of investigation, arrest, prosecution, and trial, because it is referred as procedural issues and the pre-trial step, so it can adopt the method of free proof, but owning to overall entity of three judicial authorities and legal supervision status of procuratorial organs in China, it is reasonable to cautiously adopt strict proof method, specifically by means of written examination, oral examination, and of obtaining, reviewing the vedio-audio recording of interrogation and so on. The working mechanism of procuratorial organs’s exclusion of illegal evidence gives priority to have a prosecutor as a undertaker, the department to discuss and the chief prosecutor to decide, with coordinating mechanisms between supervisor and subordinate, among different departments as a supplement. Procuratorial organ excluding illegal evidence in direction to the supervision or accusation may intensify the conflicts between the prosecutors and polices, prosecutors and courts.
