技术转移在创新中的巨大作用已成为人们的共识。上海现有的技术转移制度已经不能够满足建设有全球影响力的科创中心之需求。其制度存在的问题主要有：现有技术转移法律制度滞后，不当专利资助政策导致大量问题专利出现等。为此，首先应提高技术转移法律制度在创新型城市建设法律制度中的战略地位，并通过具体规章来落实和保障；同时对上海市知识产权制度进行重大改革，完善现有专利资助政策，从源头上提升专利质量，为技术转移创造条件，以促进上海创新型城市和科创中心之建设。

It has been universally recognized that technology transfer has played very important role in the innovation process. The current legal regime on technology transfer fails to meet the demands of constructing Shanghai as a center for the innovation of science and technology with the global influence. The problems of the regime are demonstrated as the following: the provisions on technology transfer obviously lag behind the economic and scientific development, and the impropriate policies on encouraging applications for patents make most patents with the poor quality, and etc. Therefore, the strategic position of the legal regime on technology transfer in the construction of innovative city shall be improved and enhanced, and this shall be implemented and secured by specific regulations and rules. Furthermore, the intellectual property regime in Shanghai shall be significantly reformed, and the financial aid policies for applying patents shall be improved to produce much more high-qualified patent, which may be the premise for promoting technology transfer, and then be much helpful for constructing Shanghai as a creative city and a scientific and technological center.
