《国家知识产权战略纲要》 明确指出其制定的目的之一是 “为提升我国知识产权创造、 运用、 保护 和管理能力”, 将 “运用” 能力置于重要位置, 表明我国知识产权战略对 “运用”的重视。 实际上从知识 产权制度的产生、 知识产权的法定主义及其本质就可看出促进知识产权运用是知识产权制度的使 命所在。 为此, 在反思知识产权制度使命及明确知识产权价值重在运用的基础上, 我国应构建和完 善以促进知识产权运用而非静态的确权、 保护为目标导向的知识产权制度。

In “Outline of the National Intellectual Property Strategy” of P.R.China, it’s definitely prescribed that one of its the purposes is to improve China's capacity to create, apply, protect and administer intellectual property (IP), which positioned the capacity to apply IP at very significant status to illustrate that the utilization of IP is attached much more importance to in the national IP strategy. Therefore, the IP system with the mobile application-oriented objective, other than static ascertaining propriety-and-protectionoriented one, shall be established in China.
