Resale price maintenance (RPM) is one of the most important forms of vertical monopolistic agreement. The kind of the said conduct is increasing continuously in China, which not only leads to the cartel among the productors or the retailers, but also can be used as the foreclosure tool by the dominant retailer. It is clear that the conduct hurts the market competiton and is helpless to promote the healthy development of market-oriented economy in China. So it is necessary to regulate the conduct. Anti-monopoly Law has created the model of prohibition-exemption via the articles 14 and 15 to regulate it, but the anti-monopoly enforcement dictates that the agencies of China have not mastered the spirit of the law and the logic of implementation. Therefore, it is imperative to interpret and implement the RPM-related rules reasonably and explore the suitable path of regulating RPM through learning from foreign advanced rules and experience.
