최근 수상공간의 적극적인 활용을 위하여 다양한 플로팅 건축물이 계획되거나 건설되고 있다. 그러나 관련 법제도의 미비로 인하여 플로팅 건축물을 설계하거나 설치하는 과정에서 많은 문제점이 발생하고 있으며 특히 민간사업자에 의한 플로팅건축물의 설치가 매우 어려운 형편이다. 이로 인해 플로팅 건축물의 활성화가 크게 저해되고 있으므로 플로팅 건축물의 건설을 위한 관련 법제도의 정비 및 개선이 필요하다. 본 연구에서는 플로팅 건축물에 대한 법제도의 현황과 문제점을 파악하고 플로팅 건축물의 유형을 분석하여 유형별로 건축물의 법적 지위를 제안하며 건축물의 대지, 인·허가, 안전 및 환경관리 측면에서 법제도 개선방안을 제시한다.

Recently, the floating buildings are planned and constructed for active use of water surface. But many problems are occurred during design and construction process due to the lack of proper legal systems on floating buildings. In specific it is very difficult for the private sector to build the floating building. This is one of the most important factors which hamper invigoration of the industry related to floating buildings. Therefore the improvement of legal system for the floating building is urgently needed. This study is to propose the ways of improvement of legal system, especially, focusing on legal status, building location and building permit whichinfluences strongly on the planning and installing floating buildings. In particular floating buildings are classified into three groups and the proper legal status for each of them is proposed.
