이 논문은 자유시장경제의 관점에서 볼 때 경제관련 한국헌법이 가진 문제점을 밝혀내고 자유 시장경제를 위해서는 헌법을 어떻게 개정해야 할 것인가를 논의한 것이다. 한국헌법은 두 가지 문제가 있다. 하나는 반 시장경제적 내용을 담고 있다는 것이다. 시장경제를 보호의 대상이 아니라 규제의 대상이라고 보고 있다는 것이다. 두 번째 문제는 첫 번째 문제에서 생 겨난 것인데, 경제에 대한 정부의 규제 권한을 억제하는 헌법적 규칙이 빠져 있다는 점이다. 다시 말하면 정부의 공권력을 효과적으로 제한할 수 있는 장치가 없다는 것이다. 이 논문에 서는 정부의 권력을 제한하고 그리고 시장경제를 보호하기 위해 헌법원칙으로서 법의 지배 원칙을 제안하고 있다. 고전적 자유주의 정치적 이상을 표현하는 법의 지배원칙은 시장경제 의 기반이 되는 법적 제도를 구성하는 원칙이다. 이런 원칙에 의해 한국의 경제헌법을 개정 해야 할 방향을 제시했다.

The subject of this paper is to explicate the problems of the economically related korean constitution from the viewpoint of libertarianism and to discuss about direction of constitutional reform in order to protect free market economy. The korean constitution contains two problems. The one is that the constitution regards the free market economy not as the object which should be constitutionally protected, but as that which is to be regulated. The other problem is the lack of constitutional rules that limit power of state authorities effectively. This paper proposes the Rule of Law, time-honored political ideal of classical liberalism, as a constitutional device that constrains government power in order to safegard free market econmy from the interventions of government. Moreover, this paper shows a direction of constitutional reform on the base of the principle of the Rule of Law.
