This article discusses how to establish “the mutual understanding” toward Restraints of Trade in Japanese Antimonopoly Law, focusing on the recent case, “Polypropylene Price Cartel Case” judged by Tokyo High Court (25 Sept.2009). Any antitrust authority all over the world confronts difficulties in identifying an agreement or intent upon cartel. To analyze communications among competitors is quite decisive, but to what extent must be shown and where is crucial divide between illegal and legal? A present attitude in this case is examined critically.
