일반 대중들은 물론이며 화재조사관련 법령의 입법자들도 화재조사가 오직 소방관 서만의 업무로 생각하거나 경찰에서 화재조사를 수행하는 이유에 대한 이해가 부족한 경우를 종종 볼 수 있다. 본 연구는 형사사법적 관점에서 경찰화재조사의 중요성을 중 심으로 논리적 고찰을 수행하였다. 발화원인이 자연적이거나 우연히 발생하였다는 점 이 명백히 밝혀지지 않은 이상, 화재현장은 범죄현장으로 간주되어야 하며 경찰은 적 극적 화재조사를 수행해야 한다. 따라서 화재조사관련 법령의 제안 및 발의자들은 화 재의 범죄 관련성을 반드시 고려하고 이를 반영해야 한다.

Oftenly, Not only the general public, but also the legislators of fire investigation related laws think that fire investigation is the job of only fire-fighters. And they have lack understanding of why the police investigate fire Scene. This study conducted a logical review focusing on the importance of police fire investigation at the standpoint of criminal justice. The fire scene should be considered as a crime scene and the police should actively conduct fire investigations until clear proof of natural or accidental fire cause is discovered. In addition, the proponents of fire investigation related laws must consider and reflect the crime-related nature of the fire.
